Answer. Because myself and family were sick, and when I
was well it was too late; I was in Cumberland at the time; I
left No. 10 in 1865, and moved back again in 1866; while I
was away I was in Cumderland.

Deposition No 33.

CHARLES O. NETHKIN, being duly sworn, deposed and said as
follows, to wit:

By Mr. Devecmon :

1st Question. What is your name, age, residence and occu-
pation ?

Answer. My name is Charles O. Nethkin; age 34; live in
District No. 10, Allegany county, by occupation a farmer.

2d Question. When did you register ?

Answer. In September, 1866, in District No. 10.

3d Question. Did you attend the election held in District
No. 10, Allegany county, Md.; did you offer to vote; was
was your vote accepted or rejected, and whose names were on
your ticket as candidates for House of Delegates.

Answer. I attended said election : offered to vote, but the
Judges said I could not vote, giving no reasons whatever ;
the names on my ticket as candidates for House of Delegates
were, William Devecmon, William A. Bryden, John Mc-
Elfish, Patrick Hammil and George W. McCulloh.

I was not afraid to vote; they did not offer to swear me,
but unconditionally refused my vote.

Cross-examined by Mr. Brown.

1st Question. Why did you not register in 1865 ?

Answer. I did not like to, and did not chose to; I have
always been loyal, never in either army during the late war ;
I never afforded any aid or comfort to the rebels, and was in
neither army; was for myself; was always loyal to the Con-
stitution.

follows, to wit:
