Answer. I attended said election; offered to vote, but the
Judges said I was challenged, and refused my vote; the
names of William' Devecmon, William A. Bryden, George
W. McCulloh, John S. McElfish and Patrick Hammil were
on my ticket as Candidates for the House of Delegates.

4th Question. Was the election held in the usual place for
holding elections in District No. 1 ?

Answer. It was not.

Cross-examined by Mr. Brown.

1st Question. Why were you not allowed to vote ?

Answer. The Judges said I was challenged; I asked by
whom; one of the Judges said he did not know; I asked
him what the challenge was; they replied that they did not
know; they asked me to take an oath; I declined, because I
had taken it when I was registered; I did not offer to reg-
ister in 1865.

PATRICK HAMMIL, being duly sworn, deposed and said as
follows, to wit:

By Mr. Devecmon:

1st Question. What is your name, age, residence and occu-
pation?

Answer. My name is Patrick Hammil, age 49, reside in
Dist. No. 1, Allegany county, and by occupation a farmer.
2d Question. When were you registered ?
Answer. In September, 1866.

3rd Question. Did you attend the election held in District
No. 1, Allegany county, November 6th, 1866, did you offer
to vote; was it accepted or rejected; and whose names were
on your ticket as candidates for House of Delegates ?

Answer. I attended said election; offered my vote, but it
was refused by the Judges; they saying there were charges
against me, and presented me the oath, which I took; the
names of the parties on my ticket as candidates for House of
Delegates, were Patrick Hammil, William Devecmon, Wm.
A. Bryden, George W. McCulloh, and John McElfish. The
Judges would not tell me what the charges were; I was a
regularly qualified registered voter in 1866, and was rnarked
on the registry books of 1865; believed to be generally dis-
loyal; I never applied in 1865 to be registered; the oath
which I took was the same as I had taken before Mr. Wilson,
the register; the Judges also offered me a long list of printed
