2nd Question. When did you register ?

Answer. In September, 1866.

3rd Question. Did you attend the election held in Allega-
ny county November 6, 1866, and did you offer to vote, and
was your vote refused or accepted, and whose names were on
your ticket as candidates for House of Delegates ?

Answer. I'attended the said election in District No. 10,
and offered to vote, but the Judges refused it. The names
on my ticket for the House of Delegates, were John McElfish,
Patrick Hammil, George W. McCulloh, Wm. A. Bryden,
Wm. Devecmon.

4th Question. Was there any armed force at the polls, on
that day, and did they intimidate voters ?

Answer. There were armed men there that day, but I
can't say that they intimidated voters. They belonged to
the Radical party.

Cross-examined by Mr. Brown.

1st Question. Describe the armed force you speak of.

Answer. I saw a number of men with rifles and revolvers
buckled to them; they stood arranged like guards; three
stood at the door. I saw from fifteen to twenty armed men ;
I saw them make no hostile demonstration; they stood qui-
etly, and held their guns in their hands. There was no
fighting or assaults of any kind; the election was peaceable.

2d Question. Why did you not vote?

Answer. I don't know; the Judges simply said I could
not vote, when I offered my ticket; George S. Lee, one of
the Judges, said all the Judges decided that I should not
vote. They proposed no oath, and said nothing about
charges; I did not appear to be registered in 1865; guns are
frequently used in District No. 10; I saw no one take the
oath on that day; can't say whether I would have taken the
oath.

1st Question. What is your name, age, residence and occu-
pation"?

Apswer. My name is John J. Whirrell; age, 23; live in
District No. 10, Allegany county, Maryland, and am a far-
