by me, did proceed then and there to take the following tes-
timony to-wit:

Deposition No. 1.

CHARLES BEST; being duly sworn, deposed and said as fol-
lows to-wit:

By Mr. Devecmon:

1st Question.—What is your name, age, occupation and
residence ?

Answer. My name is Charles Best, age 54, by occupation
teacher; residence, Allegany county, District No. 10.

By Mr. Devecmon :

2d Question.—How long have you resided in District No.
10.

Answer. For ten or twelve years.

By Mr. Devecmon:

3d Question. Did you or not attend the election held in
Allegany county on the 6th day of November, 1866, and did
you then and there offer a ticket to the Judges of Election in
District No. 10 as your ballot, and was it received or reject-
ed? and state the names of the persons on the ticket as candi-
dates for the House of Delegates.

Answer. I did attend said election; I offered a ticket to
said Judges as my ballot; it was refused. The names of the
persons on the ticket as candidates for House of Delegates
were, Patrick Hammill, Williams Devecmon, George W.
McCulloh, William A. Bryden and John McElfish.

By Mr. Devecmon :

4th Question. Were there any men about the polls with
arms, and did they intimidate and threaten any of the vot-
ers?

Answer. There were; and they did intimidate voters. Two
armed men were stationed at the door.

By Mr. Devecmon :

5th Question. To what party did these armed men be-
long?

Answer. They belonged to what is called the Radical
party.

By Mr. Devecmon :

6th Question. Were you a registered voter ?

Answer. I was.

By Mr. Devecmon:

7th Question. Did the Judges of Election give any reason
for rejecting your vote ?
