Mr. Lindsey presented the petition of Andrew Beaston and
one hundred and thirteen others, praying that a special Act
may be passed prohibiting the running at large of swine in
the 2nd Election District of Cecil county;
Which was read and referred to the Cecil County delega-
tion;
Mr. Clarke presented the petition of Lieut. Daniel Mason,
for services rendered the State as 1st Lieut. 12th Maryland
Volunteers;
Which was read and referred to Committee on Militia.
On motion of Mr. Smith,
Ordered, That so much of the report of the Comptroller of
the State as refers to the misunderstanding existing between
the Baltimore and Ohio Railroad Company and the State of
Maryland, arising out of the payment of interest on the sterl-
ing bonds from the year 1862 to 1865, inclusive, (the same
being, as claimed by said company, largely in excess of the
amount due by them to the State, and for which they make
claim against the State,) be referred to the Committee on
Ways and Means, and that said Committee be instructed to
ascertain the rights of the State, and recommend such Judi-
cial or Legislative action as in the judgment of said Com-
mittee may secure a settlement of the question involved, and
that they report by bill or otherwise.
Mr. Smith offered the following :
WHEREAS, In the report of the Comptroller of this State
for the fiscal year ending 30th September, 1866, on the sub-
ject of the Free School Fund, he says " there is a deficit in
the receipts on account of this fund when compared with the
year 1865, of $17,050 61." "This was caused," he says, "by
the failure of a majority of the banks which had been reor-
ganized as National Banks under the Act of 1865, chapter
1.44, to pay the school tax of twenty cents on every hundred
dollars of their capital stock." He also says, ". A demand
was made upon the banks for the payment of this tax as
contemplated by the Act of 1865j but it was complied with
only in" a few cases''—therefore be it
Ordered, That the Committee on Ways and Means be and
they are hereby required, to obtain a list of such banks as
have failed to pay said tax, and to inquire, if any, and what
legislation is necessary to compel the execution of the Act of
1865, chapter 144, and to take such measures as will secure
