Answer. Before a Justice of the Peace, not in person; we
made out one, and started it; but dont know what became of
it; we gave it to Jas. Chisholm, Sr., for delivery to the Clerk
of the Circuit Court; and Chisholm states he does not know
what became of it.

EBENEZER KITSMILLER, (Sworn.).

Interrog. 1. as 1 in Schedule B. E. Kitzmiller; my age,
44 years; occupation, manufacturer; residence, Election Dis-
trict No. 1. in Allegany county, Md.; and have resided there
19 years.

Interrog. 2. as 2 in Schedule B.

Answer. Was so appointed; did qualify and act as such;
not until they came to the polls.

Interrog. 3. as 3 in Schedule B. There was two; Henry
Hammill and Geo. O'Brian, because there was testimony
against them; that they were disloyal.

Interrog. 4. Did you hear of any persons advising resist-
tance to the action of the Judges of Election, or threats of
violence, in case of refusal of votes by the Judges of Election;
if so, state fully where and by whom?

Answer. I did not; I did not hear any body say so, my-
self.

1st Cross-interrogatory by A. Spates.

What was the testimony against Hammill and O'Brian;
and by whom was it furnished?

Answer. Of giving the Rebels bread and meat on a raid;
and he refused to take the oath on an election; dont know
what one; this testimony was furnished by S. W Friend.

2d Cross Interrog. Did you or any of the Judges of Elec-
tion, on November 6th, 1866, solicit any person or persons
to vote at said election; and was Samuel W. Friend a Judge
of Election in District No. 1 on that day ?

Answer. We did not; he was.

3d Cross Interrog. Did you hear S. W. Friend request and
advise Rezin Turner and A. C. Hamill to take the oath and
vote on that day ?

Answer. 1 did.

J. L. BROWNING, sworn.

Interrog. 1. As No. 1 in schedule A.

J. L. Browning; age 38 years; occupation, farmer; resi-
dence in Election District No. 1, of Allegany county, Mary-
