SIR: You are hereby notified in accordance with the pro-
visions of Sections 57 and 59, of Article 35, of the Code of
Public General Laws of Maryland, that an examination of
the following witnesses, viz: J. Chisholm, Sr., G. S. Lee, Wm.
R. Sollers, Upton F. Biggs, Isaac Thompson, Capt. Geo. W.
Wilson, John W. Sollers, Wm. Harvey, N. B. Harvey, Noah
Harvey, Middleton S. Biggs, James W. Harvey, John W.
Lee, Jacob Abernathy, Alex. Kitzmiller, A. Chisholm, Jr.,
Daniel Chisholm, B. F. Harvey, Beckwith Shrout, John W.
Irons, James W. White, Sam'l W. Friend, Win. A. Falken-
stine, Jonathan H. Wilson, Ebenezer Kitzmiller, Wm. Bray,
M. G. Harvey, J. L. Browing, Phillip Doffert, Joseph Friend,
H. B. Friend, John Riley, Wm. Hall, Wm. H. Hoye, Wm.
W. Ashby, Henry Thompson, Henry Davisand Peter Baker,
will take place at the office of Peter Baker, Esq., in the town of
Oakland, Allegany county, Md, on Friday and Saturday, the
4th and 5th days of Jan., 1867, at 10 o'clock, A. M.; by these
witnesses, Charles H, Ohr, expects to prove that the 1st, 2nd
and 4th alledged grounds set forth in your notice of contest, are
not true and did not occur, and that a number of illegal bal-
lots were cast at the election held on the 6th day of November
1866, in Districts No. 1, 10 and 15, having thereon the name
of Alfred Spates for State Senator.

If all the witnesses can not be examined in the days named,
then the examination to be continued from day to day, until
it shall be completed.

You are required to attend at the above mentioned time
and place, either in person or by attorney, for the purpose of
cross-examining witnesses.

Given under my hand and seal, this 17th day of December,
1866.

in and for Allegany county.

I hereby certify, that I served a notice similar to the above
upon Alfred Spates, at Cumberland, Allegany county,
Maryland, on the 20th day of December, 1866.
