did you offer or tender your vote to the Judges of Election ;
how long were you at the polls on the day of election; did
you see any person refused a vote on the day of election; did
not Christopher Kelley advise you to go and vote; state your
reason for refusing to vote; did or did not Mr. Kelly state to
you that every man entitled to vote should vote; and could
you not have voted if you offered ?

Answer. I cannot name the day nor day of the month, this
winter two years ago; I lived in Pennsylvania about three
years; moved there in 1861; I was registered in 1865 as a
non-resident, and 1866 as a voter, by John Diffenbaugh; 1
did not tender my vote; I am not able to say how long I
was at the polls, not more than half an hour; I suppose it
was in the morning; I presume the polls had not long been
opened; I did not see any person refused a vote on the day
of election; I have no recollection of any such conversation
with Christopher Kelley; I did not go to the polls after the
confusion and offer my vote; I think he did not use that
language, hut that every damn man that was registered
should vote; I think I could not have voted had I offered my
vote.

2d Cross-Interrogatory. What reason did you assign to the
Judges for challenging the vote of Samuel L. Wagner; was
he a citizen of the State and how long had he resided in the
county?

Answer. I challenged his vote from the fact that I had un-
derstood that he was disfranchised the Fall before; I have
known him for about 30 years and as far as I know he has al-
ways resided in this county.

3d Cross-Interrogatory. At the time you challenged his
vote, did you known of your own knowledge anything or act
that he had committed, that ought to have deprived him of
his vote, if yea, state that act, or what those acts were, and
do you know now whether he was disfranchised or refused re-
gistration ?

Answer. I know of nothing particular; I do not know of
my own knowledge that he was refused registration.

4th Cross-Interrogatory. When you challenged his vote,
was or was not your object to create disturbance ?

Answer. No, sir, it was not.

5th Cross-Interrogatory. In consequence of your challeng-
ing his vote, was a disturbance created that day, and if so,
what did you say and what did they say, and what was the
disturbance ?

Answer. I don't know that my challenging was the cause
of a disturbance that day; I do not recollect of talking to
anybody at that time, but Christ. Kelly; I was trying to rea-
son the matter with him; I suggested to him to listen to me,
but he would not listen to anything; Kelly said that any dam'd
