SIR: You are hereby notified in accordance with the pro-
visions of Sections 57 and 59, of Article 35, of the Code of
Public General Laws of Maryland, that an examination of
the following witnesses, to wit: George W. McCulloh, James
L. Hoblitzell, Caleb Dorety, Michael Sherry, Wm. Conrad,,
Wharton Mason, Douglas Perry, Neil J. Berston, Wm.
Devecman, Joseph A. Cahill, C. M. Thruston, John H.
Young, Chas. F. Bean, A. M. Adams, Theodore A. Ogle,
Henry R. Atkinson, Daniel C. Bruce, Henry Bevans, John
Boward, John Fay, Jos. M. Koerner, A. J. Clarke, L. W.
Brant, Thos. Reid, Will H. Lowdermith and William
Staples, will take place at the Court house in the city of
Cumberland, Allegany county, Maryland, on Wednesday, the
26th day of December, 1866, at 10 o'clock, A. M.; by these
witnesses, Charles H, Ohr, expects to prove that the third
alledged ground set forth in your notice of contest, is not
true and did not occur, and that you were not, and constitu-
tionally and legally, could not be elected as Senator for said
Allegany county.
And you are further notified as aforesaid, that on Thursday,
the 27th day of December, 1866, at 10 o'clock, A. M., at the
same place above mentioned, the following witnesses will be
examined, to wit: James W. Furlon, Griffin Twigg, Lloyd
Stallings, James M. Mathews, John H. Stallings, Capt. J.
Morrow and James Mathews, of District No. 7, in said county,
by these witnesses, Charles H. Ohr, expects to prove that by
threats, violence and deportment of a large number of men
of Conservative politics, legal voters who would have voted
for Charles H. Ohr for State Senator, were prevented from,
offering or tendering their ballots to the judges of election at
the polls in said Election District No. 7, and that by the
threats, violence and deportment above mentioned, a large
number of illegal ballots were cast at said polls for Alfred
Spates, for State Senator, at the election held on the sixth
day of November, 1866.
If all the witnesses cannot be examined on the days named,
then the examination to be continued from day to day, until
the examination shall be completed.
You are required to attend at the above mentioned times
and place, either in person or by attorney, to cross-examine
witnesses.
