Answer. I know now that Mr. Bevans and Mr. Fay, above
spoken of are sworn deputies. I did not know it when I an-
swered the former question.

By Dr. Ohr.

Question. Who is the chief deputy Clerk in said Clerk's
office ?

Answer. There is no chief deputy—all act alike.

Alfred Spates here files with me, J. M. Strong, Justice
as aforesaid, certain papers, to be used as evidence in this
case, same being marked "Exhibits Nos. 3, 4, 5, 6, 7, 8, 9,
10 and 11," and endorsed by me as filed with me by said
Spates, at the date thereon endorsed.

There being no other witnesses to be examined, and said
Alfred Spates not desiring further time for the production of
evidence, I closed the said taking of testimony, and return
the depositions so taken by me, closed up under my hand
and seal, this 29th day of December, A. D. 1866:

And I also return herewith the poll books used, and the
ballots cast at the late election in Allegany county, on the 6th
day of November, 1866, as the same were delivered to me by
Horace Resley, Clerk of the Circuit Court for Allegany coun-
ty, aforesaid.

STATE OF MARYLAND,

Allegany County, to wit :

1 hereby certify that Jos. M. Strong, Esq., before whom
the annexed affidavits were made, and who has thereto sub-
scribed his name, was at the time of so doing, a Justice of
the Peace, of the State of Maryland, in and for Allegany
county, duty commissioned and sworn.

In testimony whereof, I hereto set my hand
[SRAL ] and affix the seal of the Cirucit Court for Al-
legany county, this 29th day of December, 1866;
