hereinafter stated. The key of the said ballot box is kept in
the Clerk's Office.

By Mr. Spates:

Question. Did you or not, on the 17th November, 1866,
attend at the examination and inspection of the votes and
poll books; conducted by Messrs. Carleton, Young, Adams,
Ogle, Gonder and Hoover, on that day; if so, what ballots
and poll books, if any, did you deliver to them to be counted
and inspected ?

Answer. I did attend at that inspection on that day. I
was not there the whole time, but when I went out from
there I left Henry Bevans, another Deputy Clerk, in my
place until I returned. I saw the above named parties
counting the votes and inspecting the poll books they had
before them at that time. It was I who saw these ballots
and poll books taken out of the ballot box, and they are the
same that were returned by the Judges of Election, as stated
in ray answer to the third question above. I delivered the
said ballot box to them, the parties above named, and saw
them take the ballots and poll books out of it and count
them. After these parties had counted the ballots, the ballots
and poll books were returned to and deposited in the ballot box
aforesaid, and are now in the Clerk's Office, locked up. Subse-
quent to the said examination, John Fay, a Deputy Clerk in
the office with me, took the ballots out of the ballot box and
afterwards replaced them in it, for the purpose of making a
copy of some of the papers therein. I am a Deputy Clerk
in the Clerk's Office of Allegany county.

Question. Did any person or persons, between the 10th
and 17th day of November, 1866, after the poll books and bal-
lots had been deposited with you, examine the said poll books
and ballots, deposited by the return judges of election, held
in Allegany county, Maryland, November 6th, 1866; if so,
name him or them, and when it was done and who waa pre-
sent ?

Answer. No, not to my knowledge.

By Dr. Ohr.

Question. Have you or any of the other deputy Clerks, now
in the said Clerk's office, of the Circuit Court for Allegany
county, named in the foregoing depositions, beea sworn as

such ?

Answer. I have not been sworn as such. I don't know
whether or not the others have been sworn as such deputy
Clerks or not.

Question. If they had been would you not likely know it?
