Answer. I went to the polls on that day in Election Dis-
trict No. 10, where I was registered and offered my ballot,
and it was rejected by the judges; I desired to vote for Alfred
Spates for State Senator. The judges refused to take my vote
unless I would take the oath again; I declined to take the
oath, telling them I had been registered; I went away with-
out voting.

I asked them why they asked me to take the oath again;
had I not been registered by a Register appointed by the
Governor of the State ? one of the judges replied then, that
" the reason why that had to be done was, that the Governor
himself was disloyal, and had committed several disloyal
acts; If he had been a loyal man, we would have had none of
this to do;" these are, as well as I can recollect, his words.

By Mr. Spates:

Question. To which of the political parties did the Judges
of Election in District No. 1 belong, and what are their
names ?

Answer. They belonged to the Radical party; their names
are James Chisholm, Sr., George 8. Lee and William
Waltz.

By Mr. Spates:

Question : Do you know any other matter or thing that
would be of benefit to the Contestant in this case ?

Answer. When I went to the polls on that day, I saw a
number of armed men there, more than I ever saw before at
any election; some with pistols belted around them; some
with guns and some with pistols and guns both.

By Mr. Spates.

Question. To which of the two political parties did said
armed men belong ?

Answer. They belonged to the Radical party; I saw one
man there have a gun, who, I understood was a Conservative
man.

Crsss-examined by Dr. Ohr.

By Dr. Ohr:

Question. When were you registered as a voter?
Answer. In 1866.
By Dr. Ohr:

Question. Did you apply for registration in 1865 ?
Answer. I did not.
By Dr. Ohr :

Question. Do you or do you not know that you had then
been registered as disqualified for disloyalty.

(Objected to by Mr. Spates :)
Answer. I did not know until I went to be registerd in
