Answer. I did not.
By Dr. Ohr :

Question. Is it not customary with many of your people to
carry their rifles to public gatherings; and have you not seen
them with their rifles and guns at former elections?

Answer. I have seen on former elections a few guns with
parties, but never saw such an armed display of small arms
and large arms at an election before. It was currently re-
ported that they were coming there to carry the election by
force of arms.

By Mr. Ohr:

Question. By whom was it intended to carry the election
by arms; and from whom did you hear the report; and did
you hear any Abolitionists or Radicals say they so intended ?

Answer. By the Radicals; the report came through my
family, the Hoyes. I did not hear any Radicals say so, for
I had no conversation with any of them politically.

By Dr. Ohr.

Question. To what party do your family, the Hoyes, be-
long ?

Answer. To the Conservative party.

Deposition No. 3.

ELLIOT C. TABS, having been by me duly sworn, deposed
and said as follows, to wit:

By Mr. Spates.

Question. What is your name, age, occupation and resi-
dence, and how long have you resided there?

Answer. My name is Elliott C. Tabb, aged 40 years, occu-
pation, farmer and grazier, and reside in Ryan's Glade Dis-
trict No. 10, in Allegany county, Maryland, for the last
even or eight years.

By Mr. Spates:

Question. Were you registered as a voter prior to the elec-
tion held in said Allegany county, on the 6th day of Novem-
ber, 1866 ?

Answer. I was.

By Mr Spates:

Question. Did you or not attend at the polls in said Elec-
tion District, in Allegany county, on the 6th day of Novem-
ber, 1866; if so, did you then and there offer a ticket to the
Judges of Election, at said polls, as your ballot and was it
received or rejected; state also the name of the person printed
on said ticket for State Senator, for whom you desired to vote;
and what reason did the said judges assign for rejecting your
vote, if they did so reject it ?
