MEMORIAL.
To the Honorable,
The Senate of Maryland :
The memorial of Alfred Spates, of Allegany county, Mary-
land, respectfully represents that he was a candidate for a
seat in your body at the election of November 6th, 1866, as
the representative therein of said Allegany county, and, that
a large number of votes at that election were cast for him
for that office, and at the same time a large number of votes
were cast also for Charles H. Ohr, who was returned as
elected.
Your memorialist further represents that believing that
said Ohr, was not duly elected to a seat in your body
and designing to contest his seat, he served upon the said
Ohr, a notice of his said intention, a copy of which notice
is hereto annexed. He further represents that subse-
quent to said notice, he did, in accordance with the laws of
the State of Maryland, served upon said Ohr, a notice of his
intention to take testimony to substantiate his position, and
thereafter, at the time fixed in said notice, he proceeded
in the presence of said Ohr, to examine witnesses and take
testimony, to that end, a transcriptof which testimony will by
the magistrate taking the same, be transmitted to the pre-
siding officer of your Honorable body, as required by law.
Your memorialist submits that the testimony so taken
fully sustains his position and belief that the said Charles H.
Ohr, was not duly elected and he therefore prays your Hon-
orable Body to declare that said Charles H. Ohr, was not
legally and duly elected, and is not therefore entitled to a
seat in your Honorable Body; but that your memorialist is
the person who was duly and legally elected to such seat, at
the said election of November 6th, 1866, in said Allegany
county, and entitled to occupy the same.
