Sections re-
pealed. |
. Sec. 2. And be it further enacted. That sections
9, 11, 12, 15, 17, 18, 22, 25, 26, 27, and 28, of
chapter three hundred and forty-six of Laws of
Maryland, passed January session, eighteen hun-
dred and sixty-four be repealed and re-enacted so
as to read as follows : |

give receipt. |
Sec. 9. All tobacco landed or delivered at any
of the warehouses in the city of Baltimore for in-
spection, shall be taken charge of by the inspector
appointed to said warehouse, who shall be respon-
sible therefore to the person delivering the same ;
and if he refuses to take charge of any such to-
bacco, or to give his receipt therefore when re-
quired, he shall be liable to a penalty of one hun-
dred dollars to be recovered in any Court of Law
in this State, without prejudice to the right of ac-
tion upon his official bond as hereinbefore pro- |

vided; provided, he shall not be liable as afore-
said if his warehouse be full and he shall have
secured room for said tobacco so delivered, in some
other warehouse or elsewhere; and provided fur-
ther, that if any inspector shall refuse to receive
tobacco sent to him from any of the other ware-
houses by the inspector or inspectors thereof know-
ing his own warehouse to be capable of receiving
the same, ho shall bo liable as mentioned in this
section. |
Cooperage. |
Sec. 11. All tobacco delivered at any warehouse
in such condition as to require cooperage, shall be
properly taken care of by the inspector, who shall
notify the agent of the owner of such tobacco that
cooperage is required, and the said agent, if in
his judgment the same shall be necessary, shall
have the same coopered at the expense of the own-
er, charging therefore a sum not less than twenty-
five (25) cents, nor more than fifty (50) cents for
each hogshead thus coopered. |

Sec. 12. It shall be the duty of each tobacco
inspector, unless prevented by sickness or unavoid-
able accident (and in that event he shall designate
some competent person, sworn beforehand before
some Justice of the Peace in the city of Baltimore
to perform faithfully the duty of inspector) to cause |
