session of eighteen hundred and sixty-four, chapter
two hundred and seventy, entitled, an Act to au-
thorize and empower the commissioners appointed
by the Circuit Court of Queen Anne's county, to
divide the real estate of John Hendrix, late of said
county, deceased, and to convey to the purchaser
the legal title to said lands, be and the same is
hereby repealed and re-enacted as amended, as
follows: |

WHEREAS, Anna Maria Brice, late of Queen
Anne's county, died seized in fee of two hundred
and forty-three acres, three roods and three perches
of land more or less leaving sundry children and
heirs at law, to whom said land descended and
who were seized thereof in fee; and whereas, a
commission on petition under the Act of descents,
was issued by the Circuit Court of Queen Anne's
county to five commissioners of said county, to
make division of the said land among the persons
entitled, but the said land being returned by said
commissioners as incapable of division, the same was
thereupon ordered by the court to bo sold by the
said commissioners on terms prescribed in the
order; that the commissioners sold the same to a
certain John Hendrix, of Queen Anne's county,
and took his bond or bonds for the payment of the
net proceeds of the purchase money to the several
heirs at law of the said John Hendrix and per-
sons entitled thereto; and whereas, the said John
Hendrix afterwards died intestate, without having
paid the full purchase money on said land, leaving
a number of children his heirs at law, to whom
the said land descended; that a commission was
afterwards obtained under the Act to direct de-
scents, by petition, from the Circuit Court of
Queen Anne's county, to five commissioners to
make division of said land among the children
and heirs at law of said John Hendrix, deceased;
that the said last mentioned commissioners made
return to the said court, that the said lands could
not be divided among the heirs at law of the said
John Hendrix; that the court thereupon ordered
the said commissioners, or a majority of them, to
sell the said real estate on terms prescribed by said
order; that the said commissioners in pursuance
of said order of the court sold the said lands and |
