134 H. Nelson Crawford, a witness produced on behalf of claimant, being duly sworn, answers and says: 1st. Interrogatory: A. Thirty-nine years, been a voter twenty-years; resided in 1865, in District No. 2. 2d. A. Did apply; confronted with no witness and notified of no charge. I first applied about two weeks before the time for closing the books of Registration, as required by law, I did so. with the express understanding that I could come in again at another time and take the oath. About, two weeks afterwards I applied when Registers refused to administer the oath. Mr. Rider Nelson, one of the Registers, after hearing what talk I had, said he would propose that myself and Mr. Levin Bounds should have the oath administered to us, and when he went, back in the room he did propose it and it was overruled. Mr. Pusey, one of the Registers, .said he would come to Salisbury that night and take counsel, and bid us come next day; we came next day but they still refused to administer the oath. This day was the last day of their sit- ting; after they had closed their sitting for that day, Mr. Pusey met me on the street and said to me if I would come up to Mr. Mills, one of the Registers, next day, that he would administer the oath to me, and also to Mr. Bounds. We went and the oath was administered to us there; I answered all the questions, was not registeerd as a loyal voter. 3d. A. Did not vote; would have voted for J. R. Franklin. 4th. Waived. Cross-examination: Question. At the time you first presented yourself before the Registers, did you or not refuse to take the oath required by law ? Answer. I simply declined, with. the, understanding that I could come in afterwards and take it; I had not made up lay mind. To the first cross interrogatory: A. I have no knowledge of expressing it to my one, one thing I knew, I was sorry to hear of the battle; I have not been gratified of any success oil either slue during 'the w;n . 2nd. A. I was sorry it happened. 3rd. |
