JANUARY, 12th,
Met pursuant to notice at 10 o'clock.
Dr. Thomas W. Stone a witness-: produced on behalf of
claimant being duly sworn, answers and says:
1st. Were you or not one of the Judges of Election at the
election held in Somerset county on 7th of November last? if
yea state in what district; was or not a paper purporting to
be a list of qualified voters in said district laid before the' said
judges; if yea, when and by whom; it said paper is in your
custody will you produce and file the same in evidence?
A. I was in the District No. 10, (Hungry Neck) such paper
was laid before the said judges, in the morning when polls
were opened by Captain William A. D. Bounds one of the
judges of election: I produce and herewith file the same.
3d. State whether or not the judges of election conducted the -
said election in accordance with said paper or rejected it as evi-
dence of a legal registration in said district; and how did you
conduct the election?
A. We rejected it; we opened the polls to all voters who
applied belonging to the district.
3d. Did the judges, of which you were one, at. that election
permit any voter to cast his ballot who in your judgment
was not a legal and qualified voter according to the Consti-
tution and law of this State?
A. We did not. .
Cross-examination.
1st. Is the paper which you have produced and made part
of your evidence in answer to the 1st interrogatory the same
in all respects as the paper given to you by Captain Wm. A.
D. Bounds as you have testified?
A. It is the same paper with the exception of the writings
in pencil thereon.
2d. By whom was that writing in pencil made?
A. As well as I can recollect but am not positively sure.
I think it was made by Mr. Edgar Jones.
3d. Was not. Mr. Edgar Jones one of the judges of elec-
tion ?
A. He was; but I am sure it was not done until alter the
list was thrown aside.
4th, Did you apply for registration as a, qualified voter to
the officers of registration of the 10th election district?
A. I did not.
