82 loyalty; was notified of no charge, but two of the officers said they would testify to my loyalty; I appeared on the first day to be registered; took the oath; they asked me no questions at all; the second day was notified by two of the officers that I must have witnesses to testily to my loyalty; Captain Ruberd D. Wallace, one of the officers, testified that he had never heard me use any disloyal language; was pub- lished as a loyal voter; at the last meeting Captain William Carey was called to testify to my disloyalty, and on his tes- timony I was rejected; after the election, before one of the registers, I asked Carey if he was a witness? Carey said he would swrear on a thousand Bibles, or before any court, he did not act as such a witness, and that my name was not mentioned. (This objected to by Contestant, as hearsay.) Mr. Carey is generally considered one of our best men, and a class-leader in the Church. 3d. A. I did not vote because I was not registered; would have voted for J. R. Franklin. 4th. Waived. Special interrogatories: 1st. When you say Captain William Carey was called as a witness against you, what do you mean ? A. I mean he was summoned, as the enrolling books show; but I do not know he was summoned except from that fact ; I was not notified of it. 2d. What do you mean by enrolling books? A. I mean the books of Registration. 3d. Before which of the registers did you call upon Oapt. Carey if he was a witness against you? A. Captain Wallace. 4th. What did Captain Wallace say, and was he or not one of the registers ? (This question objected to.) A. Captain Wallace said Carey did testify, and would have to stick up to it. Cross-Examination: Did you feel or express any regret at the defeat of the United States army at the first battle of Bull Run ? A I did not, only that I wanted the right side to whip; and I did not know which side that would be. |
