A. I believe we had no such cases as this.
35th. Was not opposition to the war considered disloyal?
A. Generally it was, but not so in all cases.
36th. Was not the belief of the applicant that the Govern-
ment was wrong and doing wrong in prosecuting the war a
sufficient cause for disqualification in your estimation?
A. It was if he entertained those opinions at the time of his
application.
37th. Was not the voting for L. S. Waters for Senate of
Maryland deemed by your board evidence of disloyalty?
A. I do not think we ever thought of any such thing. I
am sure I did not.
; 38th. Was not a belief by the applicant that the Govern-
ment had no Constitutional power to subjugate the South
esteemed evidence of disloyalty?
A. We are not responsible for any erroneous belief; I dis-
charge my duties fairly and impartially to all and I believe
so did my colleagues.
39th. In all cases where witnesses were entered against an
applicant were such sworn?
A. I think they were. I did not aim to enter any one as
a witness except he was sworn.
40th. Please state what the proof was against G. E. Banks?
A. I do not recollect.
41st. Do you remember the declaration testified to by John
C. Crockett against Joshua P. Jacks?
A. I do not.
42d. Who was sworn in the case of James W. Kent?
A. I think Mr. Crockett was; I am not sure.
43d. What was the evidence against him?
A. I decline to give the reasons for our judgments in such
cases.
44th. Did Mr. Denston in his testimony against Mr. Ma-
lone say he had ever heard Mr. Malone express a desire that
the South should whip the North ?
A. I do not recollect the evidence entirely.
