EXHIBIT A.
THE STATE OF MARYLAND, Somerset county, to wit:
TO THE HON. THOMAS A SPENCE.
WHEREAS, the Hon John B. Franklin has applied to me as
a Justice of the Peace of the said State, in and for the
county aforesaid, to take the testimony of witnesses to be pro-
duced by him before me as such Justice, to testily in the
matter of your contest of his election as Circuit Judge of the
Twelfth Judicial Circuit of Maryland, at an election held on
the 7th of November, 1865, I hereby notify and require you
to attend in person or by attorney at Princess Anne, at my
office, in the Fifth Election District in Somerset county, on
Tuesday, Wednesday and Thursday, the 9th, 10th and 11th
of January, 1866, at 10 o'clock A M.; on Saturday, the 13th
of January, 1866, at the Peninsular Hotel in Salisbury, in
said county, at 10 o'clock A. M.; on Monday and Tuesday, the
loth and 16th of January, 1866, at the house of Joseph
Bralten, at Barren Creek Springs, at 10 o'clock A. M., and
at the Hotel of James F. Adams, in Reheboth in said county,
on Thursday, the 18th, at 10 o'clock A. M., and cross-ex-
amine witnesses whose names are hereunto annexed, to Toe pro-
duced before me by the said John R. Franklin, in relation to
the facts herein stated.
1st. To prove that the Officers of Registration in the sev-
eral districts of Somerset county did not qualify by taking
the oath required by law, the following witnesses will be
examined, to wit:
Joseph A. Philips, Francis A. Hatton, Rider W. Wilson,
Oliver P. Insley, Levin B. Price, Richard D. Wallace, Da-
vid Shockley, William M. Duncan, Major A. Robinson,
Jacob White, Nicholas H. Jones, Thomas S. Dougherty, C-
B. Simondson, Francis A. Hall, Samuel Ford.
To prove that. the Officers of Registration of said county
gave no notice, as required "by law, of the time, place
and object of their meeting, the following witnesses are pro-
posed to be examined:
Charles W. Fountain, David Tyler, Thomas S. Hodson,
James W. Wilson, George W. Parsons.
That no list of qualified voters in the several districts of
said county was filed with the Clerk of the Circuit Court for
said county as required by law, the following witnesses are
proposed to be examined:
Littleton Long, Jr.,. Isaac Gittens, Levin Woolford,
David Tyler, Samuel Gittens.
