Parks, being duly sworn, deposeth and saith, to the 8th and 9th interrogatories, that I am a registered and qualified voter in Election District No. 5, of Somerset County, Maryland, and did vote at said election for Thomas A. Fitzgerald, being duly sworn, deposeth and saith, that I, when I offered my vote, the judges of election refused my vote, assigning as a reason that the name copied from the register was Gerald, instead of Fitzgerald, as it appeared upon the register, but afterward received my vote (as Jesse Fitzgerald.) I voted at said election for Thomas A. Spence, for Circuit Judge of the Twelfth Judicial Circuit of Mary- land, being a registered and qualified voter in said district. JESSE B. FITZGERALD.
