the 8th and 9th interrogatories, that I am a registered and
qualified voter in Election District No. 5, of Somerset
County, Maryland, and did vote at said election for Thomas
A. Spence, for Circuit Judge of the Twelfth Judicial Circuit
of Maryland.

December 26, 1865.
Severn McGrath, being duly sworn, deposeth and saith,
that I am a resident of Election District No. 5, of Somerset
County, Maryland, that I was duly registered as a qualified
voter in the book of registration by the officers of registra-
tion of said district, that I offered my vote to the Judges of
Election in said district on the Seventh day of November
last, but they denied my right to vote for the reason, as they
alleged, that they could not find my name on the list of
qualified voters for said district; it was about midday when
I offered to vote; had I been allowed the privilege of voting,
I should have voted for Thomas A. Spence, for Circuit Judge
of the Twelfth Judicial Circuit of Maryland. I was told by
Mr. Polk, one of the Judges of Election, that my name was
on the list which they had as Levin McGrath.

Charles Hemingsway, being duly sworn, deposeth and

tered and qualified voter in Election District No. 5, of Som-
erset County, Maryland, and did vote for Thomas A. Spence,
at said election, for Circuit Judge of the Twelfth Judicial
Circuit of Maryland.
