And the said William J. Porter further deposes and says:
That Gilliss Trehearne is a registered and qualified voler in Elec-
tion District No. 5, of Somerset County, Maryland, and did vote
at said election for Thomas A. Spence for Circuit Judge, of the
Twelfth Judicial Circuit of Maryland.

January 1st, 1866. (
The undersigned, being duly sworn before Edward F. Duer, a
Justice of the Peace, of the State of Maryland, in and for Som
erset County, deposes and saith in answer to the first question:
1st. I was present from the time the polls were opened in
the morning, until they closed in the evening, at intervals.
3d. That Samuel B. D. Jones. Littleton Polk, and James M.
Dryden were the Judges, John W. Polk and William H. Brown
were the Clerks.
3d. That it is so believed in this community, and neither
has been nor will be denied, I presume, by any one the truth of
this allegation.
4th. Such paper they had, and stated that that paper was their
guide, and should be governed by it alone. They did refuse the
votes of several persons, assigning as a reason, the omission of
some letter or portion of their names from the said list.
5th. They did, from the time the polls were opened, up to
about the hour of (1) one o'clock, P. M.; after or about that
time the list was disregarded in toto.
6th. They received votes without regard to the list of regis-
tered voters, and up to the time of such disregard of the list, the
votes were certainly largely in favor of Judge Spence.
7th. I saw the list which the Judges had before them, hut did
not examine it, supposing, of course, that it was a correct list ;
had no knowledge upon which I could certify other than this.
8th. I am a registered and qualified voter in Princess Anne, the
5th Election District of Somerset County, Maryland.
