Matthew Scarbrough late of Somerset County Gent. was Attached to answer unto Stephen Page in a plea of trespass upon the Case. - - - - - - - - - - - - - - - - - - - - And whereupon the sd Stephen by Peter Dent his Attorney Complaineth that the sd Matthew the 12th day of November in the yeare of our Lord 1688. at Monocan with in the Jurisdiction of this Court/ was indebted to the said Stephen in the sum of three pounds seven shillings sterling, as by a perticul-- amount thereof hereunto anexed may appear and the sd Matthew to the sd Stephen in manner sforesd being indebted the sd Matthew in Consideration there of did assume upon him Selfe and to the sd Stephen then and there faithfully Promise that he the sd Matthew the sd sum three pounds seven shillings Sterling the said Stephen when he should be thereunto requested would well and truly content and pay nevertheless the said Matthew by promise and assumption aforesd not regarding but minding and fraudulently intending the sd Stephen in this behalfe, Craftily and Subtilly to deceive and defraud the sd Sum of three pounds Seven shillings sterling to the sd Stephen hath not paid, although the sd Matthew to doe the same by the sd Stephen afterwards the day and place aforesd was requested but hath hitherto refused, and doth still refuse to the damage of the sd Stephen of ten pounds Sterling and there of he bringeth his Suite. Scarbrough.Deft. he render unto him two Nigroes (viz) one Nigroe betwixt twelve and twenty four years old and one likely young Nigroe and five Pound in goods at the first Cost as they should come to him which he oweth and unjustly deteineth &c. - - - - - and whereupon the said Stephen by Peter Dent his Attorney, saith that the sd Matthew the 14th day of Janry in the year of our Lord 1688. at Monokin within the Jurisdiction of this Court by his certain Bill Obligatory which the said Stephen with the seal of the said Matthew signed bringeth here into Court, the date whereof the day and year aforesd acknowledged himselfe to be bound to the sd Stephen in the sd two Nigroes and five pounds in goods to be pd to the sd Stephen, the one by last of March Ensueing the date and the ofther at ye retourn of his Ketch from Barbadoes, and the sd five pounds in goods to be delivered at his retourne from Wye River all which severall paymts, well and truly to be made the sd Matthew bound himselfe firmly by the sd Bill Never the less the sd Matthew, the sd two Nigroes, and five pounds in goods, according to the tenor of the sd Bill although often demanded the same, to the the sd Stephen hath not rendered, but hath hitherto denyed and doth still deny to the damage of the sd Stephen of 30000 pounds of tobacco and thereupon he bringeth his suite &c.
