17 Capt David Browne Plt. August 29th 1690 Harris Bill delivered to agt. mr Edward Jones pr Coll. Browns Order as In Richard: Harris. Defdt. caps Somerset County Ss. Richard: Harris late of this County was summoned to answer unto Capt. David: Browne. the Execcutor of the last Will and Testament of Archibald Ereskin late of this County. deceased and to John: Boreland of New England Merchant in a Plea of debt. - - - - - - - And Whereupon the Plts. by theire Attorney Edward Jones saith that the said Richard: Harris upon ye 21th. day of January in the year 1688/7 then became indebted unto the Plt. in the sum of 713. pounds of Tobacco as does appeare by a certaine writing under the hand and seal of the Defdt. and here in Court produced but the Defendant litle regarding his promise and assumption but fraudulently intending the Plts. to deceive in the aforesaid Sum 713 pounds of Tobacco although often there unto required whereupon the Plts. saith they are damnifyed and hath loss to the value of 1200 pounds of Tobacco and thereupon brings there suite. pr Quer. Edward: Jones Know all Men by these presents that I Richard: Harris of the County of Somerset and Province of Maryland Gentm. doe owe and am indebted justly unto David: Browne of the County and Province aforesaid. Execcutor of the last Will and Testament of Archibald Ereskin late of this County deceased. John: Boreland of Boston in New England Mercht. the full quantity and just sum of seaven hundred and thirteen pounds of Tobgood sound Merchandable Tob. cleare of ground leaves or any manner of trash. whatsoever with Caske to containe the same conveniently delivered at Snow hill Landing at or before the tenth day of february next ensueing the date hereof it being for a valuable consideracon in hand received before the ensealing and delivery hereof To the whish payment well and truly to be made to the aforesaid Browne and Boreland there Heirs. Execcutors, Administrators or Assigns, I the aforesaid Richard: Harris: Harris doe bind me my Heirs Execcutors & Admrs Joyntly and Severally firmly by these presents.
