August 14th. 1690. (160) - - - - - - - - - - - - - - The Deposition of Martha Venables taken before me this sixth day of March 1689. who being duely sworn upon the holy Evangelists and examined saith that upon the fourth day of June last or there abouts that William Jenkins of Animessex deteined and kept her Brother Joseph Venables Apprentice William Jenkins Junior by name from his said Maters Service and the deponent desired the said William Jenkins Senior not to keep the Boy from her, but if he would detain him that he should take him from his Master Joseph Venables and not from her but the said William Jenkins Senior said that he could not spare the Boy from planting of tobacco, and deteins him ever since and further saith not. Sworn before me John: Winder. // The Court having Considered the premisses do Order that William Jenkins Senior, give Security to Send the said William Jenkins Junior forth with, or at furthest before Weddnesday next to his Said Master Joseph Venables. And for the damages due to the sd Venables, is to be assest by the Court. mr Thomas Jones Security for the delivery of the said Boy to his Master according to time Walter. Mackhenry. Plt. Somerset County Ssc. William Tisdale and Rich: ffarewell were agt. Sumoned to answer unto Walter. Mackhenry in an action of Debt Wm.Tisdale.& Rich:Farewell Defts And whereupon the plt by his Attorney Edward Jones Comes and Sayes that the defendts became indebted unto the plt upon the twenty Second day of ffebruary 1687.in the full and just Sum of nineteen hundred pounds of tobacco the which Sum being due as by a Bill here in Court produced will more plainly appear wherein they the defendts, did assume and faithfully promise to pay unto the plt but their promise or assumption litle regarding but fraudulently the plt to deceive hath denyed and still doth deny to pay the same though often thereunto required by the plt whereupon the plt saith he is damnified & to the value of three thousand eight hundred pounds of tobacco, and thereupon brings his Suit. Jones pr Quer / Pledges / John: Doe Rich: Roe. And the Defendants by Peter Dent his Attorney Comes and defends the force & injury when &c. and for Plea saith that Plaintiffe is indebted to the said defendts in a debt of as high a nature as the defendt debt in the declaracon mentioned and this they pray may be enquired of by the Court &c. Dent pr Defendts.. and the plt also Edward Jones. - - - - - - Maryland Ss. Know all men by these presents that wee Wm: Tisdale of Somerset County in the Province of Maryland Planter and Rich: ffarewell of the same Mercht doe acknowledge our Selves to owe and stand indebted unto Walter:Mack henrick.of the same County and Province of Maryland Planter in the just Sum of quantity of nineteen hundred pounds of good sound Merchantable leafe tobacco and Caske to contain the Same, due to be paid unto the said Walter Mackhenrick.his Heirs.Execcutors Admrs or Assigns on or before the first day of December next ensueing the date hereof, to the which payment well and truly to be made and done wee bind our Selves & either of us Our & either of our heirs, Execcutors Admrs firmly by these presents. In Wittness whereof we have hereunto put our hands & affixed our Seals this two & twentieth day of ffebruary Anno Domini 1687.
