(120) June 12th. 1690 - - - - - - Nevertheless the said Jonathan the sd Sum of 3334. Pounds of Tobacco and Caske although often demanded the same to the sd William in his life time nor to the sd Elizabeth while she was Sole nor to the sd George and Elizabeth since the marriage between them had and solemnized nor to either of them hath not rendered but hath hitherto denyed, and still doth deny to the damage of the sd George and Elizabeth of five thousand pounds of tobacco and there of they bring their suit &c. And they bring into Court the lettrs testamentary &c. Dent pr quer. Pros.ec John: Doe Rich: Roe. This Bill bindeth me Jonathan Towers of Somerset County in the Province of Maryland Cooper my Heirs Executers and Administraters to pay or cause to be paid unto Coll. William: Stevens of Somerset County Merchant his Heirs, Executers Administraters or Assigns the full and just sum of thre thousand three hundred thirty four pounds of good sound Merchantable leaf tobacco and Caske Convenient at some place appointed by Act of Assembly on the Bay side in Somerset County at or upon the tenth day of October in Anno 1689 / as wittness my hand and seal this thirteenth day of October 1686. Which said Bill was Owned in Court by the sd Towers as his Act and deed &c. - - - Vide Order ---118 John: West Plt: Somerset County Ss/ John: Tayler of this County (Attorney at Law) was / agt. attached to answer unto John West of the same County in an action of defamacon John: Tayler. Deft And whereupon the plt by James Sangster his Attorney Comes and sayes that the said John: West being of good fame and in publick trust with the Records of this County, a place of no mean imploy, was by the sd John: Taylor defendt the March Court last past in the audience of severall persons of this County, most grossly, spitefully and malitiously, Reviled, defamed and slandered by the ignominious names of Rogue and Knave falsly and malitiously assirting and afirming that the plt had lost both his ears, had not he been the preservor of them, meaning for knavery and Roguery, and not satisfied with that grosse abuse and slander agt the plt, did in Aprill 89. report, publish and falsly declare that Gillian Tucker in ye house woman servant to Isaac Horsey had told him that the said Tucker lived^ with the plt in London, wher the plt killed a Woman for which the plt fled ubi revera. The said so: now the plt sayes that the defendt. hath not only defamed and slandered the plt in his good name and fame but falsly and malitiously endeavoured to call the plts life in question, Rendring him odious to all the good people of this Province and incable of Publick trust, the platiffe sayes he is damnified and hath losse to the value of five hundred pounds sterl. and hereupon brings his suit. / Sangster & Dent Attorneys for plt. George: Layfield. - - - - - - - - The above sd Declaration being read in Court, the Defendt. in his owne proper person comes and sayes that he is no wayes guilty and of this the deft puts him selfe upon the Country and John: Taylor / and the plt also. Sangster / Both parties having thus joyned Issue, referring the whole matter to the Country for tryall (viz Jury) of twelve men, which were duely and legally impannelled and sworne, who having heard the whole cause debated, as also the Evidences sworne viz 8.
