(107) The Indtmt being Read to which the sd Hamon pleads not guilty, Craves counsel which is granted viz Jno. Taylor for his Attorney. Referring the matter to a Jury. whose names are as followeth. Viz) Capt. William Coulborne. John: Vigerous. Simon: Perkins Junior Richard: Tull. Richard Hill. William: Bowen. Edward Harper. Cornelius Ward. Robert Catling. Samuel: Shewel. John: Carter. Adam: Hitch, who having heard heard the whole matter being duely impannelled and sworne goes forth and upon their retourne doe bring this following verdict. viz: Wee of the Jurers. doe find John: Hamond not guilty of the Indictment. Wm Coulborne. foreman Which sd verdict was Ordered to be entered - - - - Evidences sworne for mr Howard were George Trewett John. Trewett. Wm: White. Walter Talbott. John: Robbinson & Wm: Bowen. Their Maties Somersett County Ssc. The Jurors for their Maties being sworne upon the holy Evangelists agt. at a grand Jury held for the body of this County the second tuesday in March last past doe John Trubshaw and present and find that John: Trubshaw, together with Richard: Aldridge both of this County Richard: Aldridge planter Labourers in the month of upon the sabbath day did kill and dress One Cow and the same Cutt out, being neither a Case of necessity, or mercy, but a wilfull wicked and prophane abuse of the sabbath or Lords day, Thereby dishonouring Almighty God & contemning his sacred and divine Laws, and in contempt of the good laws & institutious of this their Maties. Province, and Scandall and evill example to all good Christians, their Maties. Attorney craves judgmt. may be entered agt the sd Trubshaw and Aldrige according to law in that Case made and provided. &c. James: Sangster Clk. Indt. The Indtmt being read the sd Trubshaw confesseth the fact, making it appearant to be a Case of necessity, and the Court thinking it an act of mercy, discharges the sd Trubshaw and Aldridge ---- Only Orders them to pay Court Charges. - - - - - - - - - - - - - - Their Maties Somersett County Ssc. The Jurors for their Maties being sworne upon the holy Evangelists at agt. a grand Jury held for the body of this County doe present and find that Jacob Pereen of Jacob:Pereen this County Mercht. in the month of January last past upon the sabbath or Lords day at the Towne of Rehobeth on Pocomoke River, and else where, att sundry other times did wickedly malitiously, spitefully and contemptuesly, abuse defame, slander and revile their Maties Comrs. for this County, and in the presence of mr Edward: Howard and others, did then and their present Openly and publickly, falsly, malitiously and advisedly said, asserted published , and with a loud voyce declared that the Justices of the sd County Court, did no Justice, or had no Justice in them, thereby bringing their authority in Contempt, their Oath and Office in question and exposing their persons to the Laws for breach of trust to the government, all which the said Jacob: Pereen hath most falsly malitiously & spitefully acted. Therefore their Maties Attorney craves judgmt may be entered aft the sd Pereen, as in law is in that Case provided &c. - - - - - James: Sangster Clk Indtmt The Indictmt being Read, with proof of severall words to the effect of the Indict by oath of mr Edmund: Howard C The sd Pereen humbly Submitted him selfe to Court being sory for his Offence imputing it to passion, craves pardon. which being considered by the Court is remitted Pereen paying Court Charges pr Order of Court. - - - - - - - - - - - - - - - - - - - - Their Maties Sommersett County Ssc. Whereas Walter Lane of this County Gent was Sumoned to answer their Maties agt for his contempt, in that the sd Lane being legally Sumoned to appear in March Court last past to give Walter:Lane in Evidence what he knew in a certain Controversie depending between their Maties and Nynoon Delap of this County Taylor according to the sd Sumon did not appear, but altogether ye authority of the same disobey and contemne, whereby their Maties was frustrated in that their just suit agt the sd delap. there fore their Maties Attorney Craves judgmt. may be entered agt the sd Walter Lane according to law in that Case made and provided.
