to the end of the fourth line of the same page, and insert " if any part of the said road, bridges or
causeways, upon which tolls shall have been received, shall be and continue to be out of good and
perfect order and repair."  In the 11th line of the 26th age strike out from the word "names" to
the end of the clause and insert " and that the same be subject to the same disposition as other personal
property of the said intestate."
    The honourable Charles Ridgely, of Hampton, has leave of absence.
    On motion, ORDERED, That the resolution respecting shares in the bank of Baltimore be made
the order of the day for to-morrow.
    The bill, entitled, An act permitting the proprietors of lots binding on the water at the west end
of the bason in Baltimore-town to extend and improve the same, was read the second time and will
pass with the proposed amendment.
    Amendment proposed.  At the end of the bill add " And, whereas by an act of assembly, entitled,
An act to empower the commissioners of Baltimore-town to make a correct survey of the
said town, and for other purposes therein mentioned, it was among other things enacted, that certain
commissioners were thereby authorised and permitted to make and open a canal, not exceeding
forty feet wide, and of a convenient and reasonable depth, from the upper part of the bason of Baltimore-town
to the ferry branch of Patapsco river, beginning the same on the bason at a street called
Forest-street:  And whereas two of the said commissioners are since dead, and the law yet remains
unexecuted; therefore, Be it enacted, That James Carroll, Richard Caton, Christopher Johnson,
David Williamson and George Pressman, or a majority of them, be and are herebY authorised and
empowered to carry the provisions of the said act into execution, respecting the said canal, in as full
and ample manner, to all intents and purposes, as the commissioners nominated under the said recited
act might heretofore have done, any thing to the contrary thereof in this present act notwithstanding;
and that they, or a majority of them, have full power and authority to lay out and run
the said canal along Forest-street aforesaid, as far as convenient, towards the said ferry branch; provided,
that in case the said commissioners, or a majority of them, shall not proceed to open and
complete the said canal within the term of seven years from the passage of this act, that then and in
such case all and every of the powers hereby vested in the said commissioners, or a majority of them,
for opening said canal, and all powers heretofore in any manner vested in any other persons by virtue
of the aforesaid act, entitled, An act to empower the commissioners of Baltimore-town to make a
correct survey of teh said town, and for other purposes therein mentioned, do far as the same relate to
the said canal, shall cease and be at an end."

The senate adjourns until 5 o'clock.
