precludes us from acting upon it in the manner you propose.  We therefore return the bill to your
house.

    ORDERED, That the order of the day for Wednesday last, which was postponed until this day,
be further postponed until eleven o'clock to-morrow morning.

The senate adjourns until to-morrow morning 10 o'clock.

F    R    I    D    A    Y,    December 16, 1796.

    THE senate met.  Present the same members as on yesterday.  The proceedings of yesterday
were read.
    The bill, entitled, An act to lay out certain roads, and authorising certain public landings, in
Worcester county, and the bill, entitled, An act to confirm the title of Levin Irving and Samuel
Smylie to the lands therein mentioned, were sent to the house of delegates by the clerk.
    The clerk of the house of delegates delivers to the clerk of the senate the following bills, to wit:
A bill, entitled, An act to authorise and empower the levy court of Montgomery county to assess
and levy annually a sum of money for the support of Hannah Carter, thus endorsed; " By the house
" of delegates, December 12, 1796:  Read the first time and ordered to lie on the table.
                                                                " By order,                          W.  HARWOOD, clk.
" By the house of delegates, December 16, 18796:  Read the second time and will pass.
                                                                " By order,                          W.  HARWOOD, clk."
And a bill, entitled, An act for extending to the securities of Thomas Gibson, late sheriff of Harford
county, a further time to complete their collection, thus endorsed; " By the house of delegates,
" December 13, 1796:  Read the first time and ordered to lie on the table.
                                                                " By order,                          W.  HARWOOD, clk.
" By the house of delegates, December 16, 1796:  Read the second time and will pass.
                                                                " By order,                          W.  HARWOOD, clk."
Which said bills were severally read the first time and ordered to lie on the table.
    The honourable James Hollyday, Esquire, to whom was referred the bill, entitled, A supplement
to the act, entitled, An act to erect a town in Queen-Anne's county, reports the following
amendments:  In the 2d line from the bottom of the 3d page, after the word "affirmation"
insert the words " as the case may be."  In the 8th line of the 4th page, after the word "reasonable"
insert the words " and lawful."  In the 5th line of the 5th page, after the word "or" insert
the word "on."  In the same line, after the word "commissioners" insert as follows: " Provided
the consent of the proprietor or proprietors of the said place be first had and obtained."  In the 9th
line of the 6th page, after the word "aforesaid" insert the words " or on any other days."  In the 10th
line of the 7th page, after the word "affirmation" insert the words " as the case may be."  In the
2d line of the 10th page, after the word "affirmation" insert the words " as the case may be."  In
the 7th line of the same page, after the words " eight feet in" strike out the word "breadth," and
insert the word "length."  In the same line, after the words " four feet in" strike out the words
" length from kerf to kerf, and insert the word "width."  At the end of the 6th line of the 11th
page insert the word "goose."  In the 7th line of the same page, after the word "any" insert the 
word "goose."  In the 11th line of the same page, after the word "such" insert the words " goose
or."  In the 13th line of the same page, after the word "such" insert the word "goose."
    Which amendments, upon the second reading of the said bill, were agreed to, and the bill passed
with the said amendments.
    The senate having previously qualified agreeable to the constitution and form of government and
laws of this state, proceeded to the election of a senator to fill the vacancy occasioned by the resignation
of the honourable James Lloyd, Esquire.  The ballot box was prepared, the ballots deposited
therein, and on examination thereof it appeared, that the honourable Robert Milligan, Esquire, had
a majority of votes.
    Whereupon it is declared in the senate, that the honourable Robert Milligan, Esquire, is duly
elected a member thereof.
    The honourable Littleton Dennis, Esquire, from the committee appointed to consider and report
on the bill, entitled, An act for establishing a company for opening and extending the navigation of
the river Pocomoke, reports the following amendments:  In the 2d line of the 1st page, after the
word "States" insert the word "of."  In the 9th line of the same page, after the word "Denton"
insert the word "and."  In the 8th line of the 4th page, after the word 'and" insert the word
"are."  In the 17th line of the same page strike out the word "member" and insert the word
"proprietor."  In the 16th line of the 6th page strike out the words "East-town" and insert
the word "Easton."  In the 10th line of the 7th page strike out the words "East-town" and
insert the word "Easton."  In the the 8th line of the 16th page, after the word "commodities" insert
the word "conveyed."  In the same line, after the word "the" insert the words " whole extent of."
In the 9th line of the same page, after the word "river" strike out the words " to be."  In the
8th line of the 17th page, after the word "staves" strike out the words " six and a quarter," and
insert " not exceeding twenty."  In the 9th line of the same page, after the word "heading" strike
out the word "four" and insert the words " twelve and a half."  In the 10th line of the same page
strike out the word "three" and insert the word "five."  In the 11th line of the same page strike
out the words " twelve and a half" and insert the words "twenty-five."  In the 14th line of the
same page, after the word "shingles" strike out the word "two," and insert the word "three."
