The report on the petition of John King was read
the second time, concurred with, and leave
given to bring in a bill pursuant thereto. ORDERED, That Mr. Pattison,
Mr. Whittington and
Mr. Goldsborough, be a committee to prepare and bring in the same.
Mr. Duckett, from the committee, brings in and delivers
to the speaker the following report:
THE committee to whom was referred the petition of John
Smith Brookes, of Prince-George's
county, report, that they have the same into consideration, and are of
opinion, that as the
state, in point of finance, does not require an immediate payment of the
principal sum due from the
petitioner, and as ample security is given for the payment of the interest,
he ought to be allowed to
pay off said debt by the following instalments, to wit: One third
of the principal sum on the first
day of January, seventeen hundred and ninety-eight, with all the interest
then due on the whole, one
other third on the first day of January, seventeen hundred and ninety-nine,
with interest on the
principal then due, and the remaining third on the first day of January
following, with interest as
aforesaid. Your committee, in order to carry the same into effect,
submit the following resolution:
RESOLVED, That John Smith Brookes, one of the securities
of Thomas Williams, late sheriff
of Prince George's county, be and he is hereby allowed to make payment
to the state in the following
manner, to wit: One third of the principal sum now due shall be paid
on the first day of January,
seventeen hundred and ninety-eight, with all the interest then due on the
said principal sum, one
other third on the first day of January, seventeen hundred and ninety-nine,
with interest on the
principal then due, and the remaining third on the first day of January
following, with interest
as aforesaid; but if the said John Smith Brookes shall neglect to pay any
one instalment as aforesaid,
then he shall be liable to be executed for said instalment, with all interest
due on the same.
All which is submitted to the house.

Which was read.
On motion, Leave given to bring in a bill to provide
for the payment of costs of suits to which
the state may be a party. ORDERED, That Mr. Wilson, Mr. Duckett and
Mr. Brother, be a
committee to prepare and bring in the same.
ORDERED, That the report on the petition of sundry inhabitants
of Baltimore county be referred
to the next session of assembly.
A petition from sundry inhabitants of Frederick
county, praying an act may pass vesting the
fee-simple of half an acre of land, formerly laid off for a public school
in said town, in visitors, and
authorising them to call for and recover all sums of money or other property
which may be due or
belong to Frederick county school, and to apply the same to the purposes
for which the same may
have been intended, and giving the said visitors all the powers and capacities
given to visitors of
county schools by the laws of this state, was preferred, read, and referred
to Mr. Brother, Mr.
Shriver, Mr. Quynn, junior, Mr. Wilson and Mr. McMechen, to consider and
report thereon.
A petition from Gabriel P. Van-Horn, of Prince-George's
county, praying the state may refund
him the purchase money paid to the agent for certain property bought of
the late intendant, which
the state cannot give him a title to, was preferred, read, and referred
to Mr. Baker, Mr. Ridout,
Mr. Jarrett, Mr. Duckett and Mr. Key, to consider and report thereon.
A petition from sundry inhabitants of Frederick-town,
praying an act may pass annexing the
several additions of Frederick-town to said town, and place the whole under
the authority and control
of the commissioners of the said town, was preferred, read, and referred
to Mr. Quynn, junior,
Mr. Shriver and Mr. Brother, to consider and report thereon.
The house adjourns till Monday morning 9 o'clock.

A Y, December 5, 1796.
THE house met. Present the same members as
on Saturday, except Mr. Chapman and Mr.
Calvert. THe proceedings of Saturday were read. Mr. John Parnham,
a delegate returned
for Charles county, appeared, and after qualifying in the mode prescribed
by the constitution and
form of government, and taking the oath to support the constitution of
the United States, took his
seat in the house.
Mr. Robins, from the committee, brings in and delivers
to the speaker a bill, entitled, An act to
confirm the title of Levin Irving and Samuel Smylie to the lands therein
mentioned; which was
read the first time and ordered to lie on the table.
A petition from the creditors of Elkin Solomon, counter
to his petition for an act of insolvency,
was preferred, read, and referred to the committee appointed on petitions
of insolvent debtors.
A petition from John Woodard, of Baltimore county, praying
an act of insolvency, was preferred,
read, and referred to the committee appointed on petitions of a similar
nature.
A petition from sundry inhabitants of Baltimore-town,
counter to the petitioner of Christopher
Hughes, and others, was preferred and read.
Mr. Goldsborough has leave of absence for a few days.
The order of the day, relative to the petition of Christopher
Hughes, and others, and the counter
petitions thereto, is postponed till to-morrow.
A memorial from the commissioners of the Federal city,
praying a loan of money, was preferred
and read, and thereupon the house proceeded to ballot for a committee,
and the following gentlemen
were elected, to wit: Mr. Key, Mr. Robins, Mr. Duckett, Mr. McMechen
and Mr. Barroll.
A memorial from George Cooke, stating, that he acted as captain of the
state armed ship Defence,
and that he received his wages in depreciated money, and praying compensation,
was preferred,
