popularly elected representative regional
governments, but excluding municipal cor-
porations."

THE CHAIRMAN: Delegate Wagandt
offers the amendment. Is it seconded?

(Whereupon, the amendment was duly
seconded.)

The Chair recognizes Delegate Wagandt
to speak to the amendment. Delegate Wa-
gandt.

DELEGATE WAGANDT: This is a
clarifying amendment. You will recall yes-
terday in the dialogue between Delegates
Case and Moser that the sections as cur-
rently worded could be interpreted to mean
that the General Assembly has the power
to create an intergovernmental authority
wholly within the boundaries of one county.

This was not the intent of the Committee
on Local Government, for as you can see,
section 7.10 is headed, "Multi-County Gov-
ernments", and this is what this section
was meant to concern.

You will also recall that questions were
raised about differences in meaning between
the words "multi-county governmental unts"
and "intergovernmental authorities". There-
fore, to clarify these terms I have sub-
mitted the following phraseology which has
just been read to you.

You will note that the term, "and other
units of local government" has been omitted
because this term raises more qustions than
it answers. The new wording "multi-county
governmental units, including intergovern-
mental authorities and popularly elected
regional governments," does not exclude
some other form of multi-county govern-
mental unit, which perhaps the General
Assembly might conceive of in ten, twenty,
thirty, or fifty years from now. The term
"and civil units" has been omitted because
as referred to in other sections of the Local
Government Article, these units are wholly
within the boundaries of a single county.

We did leave in "municipal corporations"
because a municipal corporation can cross
a county line.

THE CHAIRMAN: Is there any fur-
ther discussion? Delegate Moser.

DELEGATE MOSER: Mr. Chairman,
and ladies and gentlemen of the Conven-
tion, I think that Delegate Wagandt has
clearly stated the purpose of this amend-
ment.

The Committee also discussed this. I
think the colloquy between Delegate Case
and I clarified certain things for the Com-
mittee, and the amendment makes clear
that section 7.10 relates solely to multi-
county units of government. Therefore, un-
less some member of the Committee would
disagree with me, I would say the Com-
mittee does not oppose this amendment.

THE CHAIRMAN: Any further discus-
sion? Are you ready for the question? Dele-
gate Hardwicke.

DELEGATE HARDWICKE: Mr. Chair-
man, I wonder if Delegate Moser would
yield for a question.

THE CHAIRMAN: Delegate Moser, do
you yield for a question?

DELEGATE MOSER: I yield.
THE CHAIRMAN: Delegate Hardwicke.

DELEGATE HARDWICKE: Under the
language of the amendment, you have the
general category, multi-county govern-
mental units, and then you include certain
types of such units, I would assume. Is it
your understanding that the intention is to
list "all" multi-county governmental units
after the word "including", or "some"
multi-county governmental units after the
word "including"? Could there be other
units within this concept that are not listed?

THE CHAIRMAN: Delegate Moser.

DELEGATE MOSER: Delegate Hard-
wicke, when I was asked yesterday whether
there could be any other than the authority
and the popularly represented regional gov-
ernments I was hard pressed to come up
with examples. It is not intended to be ex-
clusive; it is intended to be without limita-
tion. I can give an example of a multi-
county governmental unit, the same ex-
ample I gave yesterday, which is not an
authority and not a popularly elected re-
gional government, the Regional Planning
Council of Baltimore. The amendment would
apply to this unit, which is not an au-
thority as it is presently constituted, as I
understand it.

THE CHAIRMAN: Delegate Hardwicke.

DELEGATE HARDWICKE: Would the
