DELEGATE BAUMANN: I would like
to record my presence.
THE PRESIDENT: It has been moved
we recess until 2:00 P.M. All those in favor,
signify by saying Aye; contrary, No. The
Ayes have it. It is so ordered.
(Whereupon at 12:33 P.M., the Conven-
tion was recessed to reconvene at 2:00 P.M.
on the same day.)
PLENARY SESSION
NOVEMBER 10, 1967—2:00 P.M.
PRESIDENT H. VERNON ENEY,
PRESIDING
THE PRESIDENT: The Sergeant-at-
Arms will clear the aisles and close the
doors.
The Convention will please come to order.
Roll call.
(Whereupon, the roll call was taken.)
THE PRESIDENT: Have all delegates
answered the roll call?
(There was no response.)
The Clerk will record the roll call. There
being a quorum present, the Convention is
in session.
We will revert to motions and resolu-
tions, to receive additional reports.
Motion No. 6. The Clerk will read the
motion.
READING CLERK: Motion No. 6, by
Delegates Adkins, J. H. Smith, and Scan-
lan.
A MOTION to amend Rule 36 [38] to
move for a limitation of debate.
THE PRESIDENT: Motion No. 6 is re-
ferred to the Committee on Rules, Creden-
tials and Convention Budget.
Minority Report JB-I(B).
READING CLERK: Minority Report
JB-1(B), by Delegates Dulany, Bradshaw,
Hargrove and Marion of the Committee on
Judicial Branch.
A MINORITY REPORT that section
5.30 of the proposed Constitution provide
for appointment of all clerks of court by
rule, to read as follows:
THE PRESIDENT: Minority Report.
JB-1(B) is received and will befiled.
I call to your attention that the previous
Minority Report is numbered simply JB-1,
not JB-1(A), because at the time it was
filed, we did not know that there would be
any other minority reports; so Minority
Report JB-I is in fact JB-I (A). This is
Minority Report JB-1(B).
Minority Report SF-1. (See footnote*)
The Clerk will read the report.
READING CLERK: Minority Report
No. SF-I, by Delegates Dukes, Koger, Mos-
ner, and Webb of the Committee on State
Finance and Taxation.
A MINORITY REPORT concerning
Committee Recommendation SF-2, being
the Committee's recommendation to con-
tinue the present constitutional prohibition
of governmental licensing or sponsorship
of lotteries.
*Subsequently the number on this Report
was changed from SF-I to SF-2 (A).
THE PRESIDENT: The report will be
received and filed.
The Chair recognizes Delegate Powers.
DELEGATE POWERS: Mr. President,
I move the Convention resolve itself into
the Committee of the Whole for purposes
of resuming Committee considerations of
LB-I and the remaining orders of the day.
THE PRESIDENT: Is there a second?
(The motion was duly seconded.)
All those in favor, signify by saying
Aye; contrary, No. The Ayes have it. It is
so ordered.
(Whereupon, at 1:06 P.M., the Conven-
tion resolved itself into the Committee of
the Whole.)
(The mace was removed by the Sergeant-
at-Arms.)
