On page 10, section 3.04, Legislative Dis-
tricts in line 9 strike out the following
words: "prior to the general election".

THE PRESIDENT: The amendment has

DELEGATE GALLAGHER: Mr. Chair-
man, ladies and gentlemen of the Conven-
tion: If you will go to line 7, page 10, and
read the sentence beginning "boundaries of
districts shall be redrawn, according to
these standards prior to the general elec-
tion in 1982, and every ten years there-
after", you will observe that it is possible
to interpret this sentence to redraw the
districts in 1980, 1975, 1976, or any year
between now and 1982. If we adopt the

amendment and drop the language, "prior
to the general election", it will be ascer-
tained that redistricting must take place in
1982 and not any year prior to 1982. There-
fore, the purpose of this amendment is to
tie down redrawing the boundaries of the
district for the year and in the year 1982
and no time before that date.
I think this is the obvious intent of the
Committee and I urge the adoption of the
amendment.
THE PRESIDENT: Is there any dis-
cussion?
Delegate Henderson.
DELEGATE HENDERSON: I would
suggest that the result could be better ac-
complished by transferring in 1982 up to
after the word "standards" so that it would
be redrawn in 1982, prior to the general
election is the way it should read. If you
take out the reference to the general elec-
tion, it might mean that it might permit
them to redistrict after the election, and
that certainly is not what is desired.
THE PRESIDENT: Delegate Gallagher.
DELEGATE GALLAGHER: That was
not the desire, Judge Henderson, and I do
think your suggestion is a good one. I
should like to adopt it.
THE PRESIDENT: Is there any objec-
tion to modifying the amendment by strik-
ing out everything after the words, "line
9", in line 2 of the amendment, and insert-
ing the words, after "standards" add "in
1982", and in line ten strike out "in 1982".
Is that your intention, Delegate Gal-
lagher?
DELEGATE GALLAGHER: I believe,
Mr. President, it was suggested by Judge
Henderson that the 1982 be inserted in line
8 after the word "redrawn" so that it
would be "boundaries of the district shall
be redrawn in 1982, according to these
standards, prior to the general election,
and in every tenth year thereafter".
THE PRESIDENT: Very well.
Is there any objection to modifying the
amendment by striking out all of lines 2
and 3 and in lieu thereof adding, in line 8,
after the word "redrawn", add "in 1982"
and in line 10 strike out "in 1982"?
