3352 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 6]

DELEGATE M. SMITH: Mr. Presi-
dent, I desire to withdraw my objection to
that word "and" on line 19, of page 5.
Upon further reflection, I think perhaps it
would prolong it, but it belongs there, but
may I suggest to you, sir, some of this is
going a little far.

THE PRESIDENT: Is there any objec-
tions to inserting on line 19, page 5, fol-
lowing the comma, after the word "years"
the word "and"?

The Chair hears none. The modification
will be made.

Are there any further changes?
Delegate Mentzer.

DELEGATE MENTZER: It is very
understandable, Mr. Chairman, why the
members are more fresh today than the
members were last night past midnight.
It is more our concern for the beautiful
document in putting in commas that is
taking so long.

I would like to call your attention to
two places on page 8, one at line 23,
where I believe to be consistent it should
say "three fifths of all the members", and
also on line —

THE PRESIDENT: Wait just a sec-
ond.

Is there any objection in line 23, page 8,
to insert the word "all" after the word
"of"?

The Chair hears none. The modification
will be made.

DELEGATE MENTZER: Also page 8,
line 44, we changed "prescribed" to "pro-
vided" and I think we did it in error.
Definitely it is a time to be prescribed in
the law.

THE PRESIDENT: Delegate Penni-
man.

DELEGATE PENNIMAN: That is
page 8, line what?

DELEGATE BAMBERGER: Line 44.

THE PRESIDENT: I think your point
is well taken.

Delegate Penniman.
DELEGATE PENNIMAN: Yes.

THE PRESIDENT: Is there any objec-
tion to changing the word "provided" on
page 8, line 44, to the word "prescribed"?

Delegate Weidemeyer.

DELEGATE WEIDEMEYER: I do ob-
ject because I do not think it prescribes
such a thing. I think it is "provided" and
I think "provided" is correct and there-
fore I object.

THE PRESIDENT: The point, Delegate
Weidemeyer, is that since the date would
be a precise date, it would be a "pre-
scribed". Do you follow that?

In other words, the point made by Dele-
gate Mentzer is that a later time, if a
later time is prescribed, it would be pre-
scribed because it would be a precise date,
and therefore it would not be providing for
a later time.

Delegate Weidemeyer.

DELEGATE WEIDEMEYER: I think
it is providing for it to take effect.

THE PRESIDENT: That is your
thought. You were reading it differently.
A suspended law which is not repealed
shall take effect thirty days after the
referendum, or at a later time; if pre-
scribed in the law to refers to the time,
and not to the first part of the sentence.

DELEGATE WEIDEMEYER: I with-
draw my objection.

THE PRESIDENT: Thank you.

Is there any objection to changing the
word "provided" to "prescribed", line 44,
page 8?

The Chair hears none. The change will
be made.

Delegate Mentzer.

DELEGATE MENTZER: While I am
doing so well, Mr. President, I would like
to call attention to page 49, Incorporation
Charters, and on line 16, there is a comma
after the word "provided". It seems com-
pletely unnecessary.

THE PRESIDENT: Where?

DELEGATE MENTZER: Page 49, line
16, after the word "provided" at the end
of the line.

THE PRESIDENT: Delegate Penni-
man, do you agree?

DELEGATE PENNIMAN: I think it
can be removed.

THE PRESIDENT: In the absence of
objection, the comma after the word "pro-
vided" in line 16, on page 49, will be
removed.

The Chair hears no objection. The modi-
fication will be made.
