3350 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 6]

DELEGATE MARION: On page 75,
line 45, we refer to section 7.04. I think it
should be followed by the words "of the
Constitution" which is consistent with the
way that has been handled elsewhere in the
Schedule.

THE PRESIDENT: Is there any objec-
tion to the modification suggested? The
Chair hears none.

Page 75, line 45, after section 7.04, in-
sert the words "of the Constitution".

Are there any other suggestions?

DELEGATE B. MILLER: Mr. Presi-
dent, I have to go all the way back to
page 5. Is this the time to do so?

THE PRESIDENT: Let me finish the
schedule of legislation first.

Delegate Clagett.

DELEGATE CLAGETT: Mr. Chair-
man, page 75, line 3, where we say not to
exceed nine. Do you think we ought to have
members or persons there so that it could
not possibly mean nine charter boards? It
seems obvious, but it does read funnily.

THE PRESIDENT: The Chairman sug-
gests that it would be better constructed
if after "board" we insert the word "of"
and after "nine" we insert "members". Is
there any objection?

If not, the modification will be made.
Page 75, line 2, after the word "board",
insert the word "of". In line 3 after the
word "nine", insert the word "members".

Are there any other suggestions as to
the schedule of legislation?

DELEGATE B. MILLER: Mr. Chair-
man, on page 5 on section 2.01, I was
looking at line 22, and it seemed to me that
there should be a comma after the word
"election" on line 22 and to be absolutely
explicit that both phrases "shall be eligible
to vote" that on line 19 after the word
"years", the word "and" should be in-
cluded.

THE PRESIDENT: Well, give me the
first change again. Comma where?

Delegate Beatrice Miller.

DELEGATE B. MILLER: After the
word "election" on line 22.

THE PRESIDENT: Do you agree, Dele-
gate Penniman?

DELEGATE PENNIMAN: Yes, that
will be acceptable.

THE PRESIDENT: Is there any ob-
jection to inserting a comma at the end of
line 22 on page 5?

The Chair hears none. The modification
will be made.

What is the second one?
Delegate Miller.

DELEGATE B. MILLER: On line 19 of
the same page, after the words "nineteen
years", and "who has", insert the word
"and".

THE PRESIDENT: Delegate Penni-
man?

DELEGATE PENNIMAN: That is ac-
ceptable.

THE PRESIDENT: Is there any ob-
jection to the further modification on line
19, page 5? Does someone object?

Delegate Marvin Smith.

DELEGATE MARVIN SMITH: Mr.
President, I am not at all sure that it
belongs there. I think that the comma em-
ploys the "and".

THE PRESIDENT: If there is an ob-
jection, the change cannot be made except
by amendment.

Is there anything further?
Delegate Burgess.

DELEGATE BURGESS: Since we are
on this draft, I wonder if I can refer to
lines 38 and 39 on page 4 of section 1.16.
From the discussion I had with Professor
Penniman, it would appear that the word
"any" on line 38 was required by the
presence of the word "that" on line 39. I
was wondering if we could delete both of
these words without changing the sub-
stance of this particular section and clear
up any misgivings or possible misinterpre-
tations of the word "any" in this instance.

THE PRESIDENT: I am not sure that
I followed your change. Would you give it
to us again.

Delegate Burgess.

DELEGATE BURGESS: I was suggest-
ing the possibility of changing on line 38
the deletion of the style change which in-
cluded the word "any" and which was ap-
parently required by the presence of the
word "that" on line 39.
