3340 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 6]

"an affirmative vote" to "the affirmative
vote" which, I think, is correct in the cir-
cumstances.

On page 51, under "Constitution Conven-
tion," "within sixty clays after such ap-
proval by the voters", drop the word
"such" in that instance and in line 14
change the word "such" to "the".

There are no changes in the transitional
provisions.

That is the end of the constitution
proper.

THE PRESIDENT: Are there any ques-
tions as to Article 10?

The Chair hears none.

Now, the schedule of transitional pro-
visions.

DELEGATE PENNIMAN: We made
virtually no changes. We were only check-
ing it to make sure as best as we could
that the sections in here related to the
same sections we had in the Constitution,
the same numbering, so, if I may, I will
just run them by pages.

We made no changes on 53, none on 54,
except in the numbering of these since
some were dropped on the floor. We had to
change the numbering of the sections.
There are none that I see on 55.

THE PRESIDENT: The Chair has
something called to its attention by the
staff working on transitional provisions.

In line 15, page 55, the reference to sec-
tion 4.31 should be 4.30 because the sec-
tions were rearranged.

DELEGATE PENNIMAN: I think that
should be checked. I think it should be the
other way around. The one in the accom-
panying memorandum is section 4.30. It
may be the one that is wrong. The staff is
checking it.

THE PRESIDENT: There is a typo-
graphical error in line 37. The obvious
error will be corrected.

Proceed, Delegate Penniman.

DELEGATE PENNIMAN: In page 56,
line 11, there is an error in the numbering.
It should be changed from 18 to 17, section
17, typographical error.

THE PRESIDENT: Typographical er-
ror in line 9, semicolon should be a period.
The obvious error should be corrected.

What is the next that you mentioned?

DELEGATE PENNIMAN: The num-
bering of the section, it should be 17 in
line 11.

THE PRESIDENT: The obvious error
will be corrected in line 11.

Proceed.

DELEGATE PENNIMAN: We made no
changes on 57, none on 58, except adding
the word "through". I think there was just
a dash originally and line 16, section 15
through 31 makes it clear there.

On page 59 we did make a change in
section 27 as requested from the floor.
There was worry about the placement of
the words "Upon the expiration of his
term" for fear it might give a wrong ref-
erence there so we put it, as requested by
the floor, on line 36 on page 59. This was
at the request of the floor when it was
discussed the day before yesterday or
yesterday.

THE PRESIDENT: What is the
change?

DELEGATE PENNIMAN: We moved
"Upon the expiration of his term" up to
line 36 to make clear the reference of it
to the judge, to any judge of any court.

THE PRESIDENT: The Committee de-
sires to modify its recommendation to re-
move the italicized words in page 59 and
capitalize the first letter of "any". Is there
any objection?

DELEGATE PENNIMAN: No, we
moved the words from 41, "upon the ex-
piration of his term", we moved those to
line 36 in connection with the discussion on
the floor the other day. We are expunging
them as indicated on line 41.

THE PRESIDENT: Very well. I under-
stand there will be an amendment redraft-
ing the language of this section. You may
proceed.

DELEGATE PENNIMAN: Mr. Presi-
dent, on the question you raised a moment
ago about the number on page 55 in sec-
tion 14, line 15, you are correct. It should
read "Sections 26 through Section 4.30."

THE PRESIDENT: Very well. The
Committee desires to modify page 55, line
15. Is there any objection?

There being none, the modification will
be made.

DELEGATE PENNIMAN: The Com-
mittee made no change on page 60 except
to capitalize the word "Constitution" in
one spot. It made no change on page 61
