TPIE PRESIDENT: Are there any ques-
tions as to Article 7?

Delegate Moser.

DELEGATE MOSER: On page 43,
Delegate Penniman, section 7.04, line 24,
would it be possible for your Committee to
accept the insertion of the word "only after
adopted" because of the language in line
38 of the next section?

DELEGATE PENNIMAN: I think that
would be acceptable.

THE PRESIDENT: Where is the
change?

DELEGATE MOSER: Line 34 after "be
adopted", put "only if approved".

DELEGATE PENNIMAN: That would
be the same style as in line 38.

THE PRESIDENT: Is there any objec-
tion to modifying the recommendations of
the Committee so as to insert after the
word "adopted" on line 24, page 43, the
word "only"?

The Chair hears none. The modification
will be made.

DELEGATE MOSER: I am referring
to the same page in line 48, the language
"or has been denied to it." The word "it"
might be taken to refer back to another
governmental unit. Would it be possible to
insert the words "the county"?

DELEGATE PENNIMAN: I think this
would be considered style and would be
acceptable.

THE PRESIDENT: Would it not be
desirable if you would make that change
to make the same change in line 45 even
though it may not be absolutely impera-
tive.

DELEGATE MOSER: All right.

THE PRESIDENT: Is there any objec-
tion to modifying the recommendations of
the Committee so that in line 45 on page
43, strike the word "it" and insert the
words "the county", and in line 48 on page
43 strike the word "it" and insert the
words "the county"?

The Chair hears none. The modification
will be made.

DELEGATE MOSER: Lastly, on page
45, line 29, I think it is, should there not
be a comma after the word "served"?

THE PRESIDENT: What line?
DELEGATE PENNIMAN: Line 29.

Yes, sir, there should be a comma after
the word "served" in line 29.

THE PRESIDENT: Is there any ob-
jection to modifying the recommendations
of the Committee so as to insert a comma
after the word "served" in line 29 on
page 45?

The Chair hears none. The modification
will be made.

DELEGATE BOYLES: Chairman Pen-
niman, I do not want to get into the pre-
scribe-provide deal because I do not really
know, but on page 45, section 7.08, line 2,
where the General Assembly may provide
and I do recall that this was by law as we
discussed this point now. Should that be a
"prescribe"?

DELEGATE PENNIMAN: Actually,
the word "prescribe by law" should be in.
It does not prescribe the referendum. It
makes possible for it. It provides for it.

DELEGATE BOYLES: Provide by law.
DELEGATE PENNIMAN: Yes.

THE PRESIDENT: What is the
change?

DELEGATE PENNIMAN: To add the
words "by law" after the word "provide".

THE PRESIDENT: Line 2, page 45.

Will the Clerk please ring the quorum
bell.

THE PRESIDENT: The Chair has
asked that the quorum bell be run because
I am very disturbed. I have been advised
that some delegates are leaving because of
the fact that it is snowing and that it will
continue snowing through the night. I
realize that this is not a very happy situa-
tion, but the fact is that in order to adopt
this constitution, we need seventy-two votes
on each and every article and division, and
I suggest that it would be calamitous if in
taking the final vote any substantial num-
ber of delegates should leave with the view
or thought that one or two absences would
not make any difference.

In addition to that, even if we had
seventy-two votes, I further suggest to you
that it would be well nigh calamitous to
have a constitution not adopted by what,
