3304 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 5]

The question arises on the adoption of
Resolution No. 28.

A vote Aye is a vote in favor of the
resolution; a vote No is a vote against.

Cast your vote.
Has every delegate voted?

Does any delegate desire to change his
vote?

The Clerk will record the vote.

There being 102 votes in the affirmative
and none in the negative, the motion is
carried and the resolution is adopted.

Resolution No. 29. The Clerk will read
the resolution.

READING CLERK: Resolution No. 29
by Delegate Scanlan.

"A RESOLUTION to amend Rule 59 of
the Standing Rules.

"WHEREAS Rule 59 of the Standing
Rules now provides: 'On the final passage
of every proposal, section, article and of
any complete revision of or amendment to
the Constitution, the vote shall be taken
by ayes and nays and entered on the
Journal and no proposal, section, article,
or any such amendment or complete re-
vision, shall be declared finally passed un-
less a majority of all the delegates to the
Convention shall have voted in favor of
the passage of the same.' and

"WHEREAS the Attorney General of
Maryland has ruled that Section 13 of the
Enabling Act, under which this Conven-
tion was convened, requires only that each
"article or division" of a proposed Consti-
tution be approved by the affirmative vote
of a majority of the Delegates on the Con-
vention, be it

"RESOLVED BY THE CONSTITU-
TIONAL CONVENTION OF MARY-
LAND: That Rule 59 of the Standing Rules is hereby amended by striking out
"section" wherever the same appears, and
inserting in lieu thereof in each instance
"or", so that the rule as amended shall
read as follows:

"Rule 59. Majority Vote on Proposals.
On the final passage of every proposal or
article and of any complete revision of or
amendment to the Constitution, the vote
shall be taken by ayes and nays and
entered on the Journal and no proposal or
article, or any such amendment or com-
plete revision, shall be declared finally
passed unless a majority of all the dele-

gates to the Convention shall have voted
in favor of the passage of the same."

THE PRESIDENT: The Chair will not
refer the resolution to a Committee at this
time. It intends to recognize Delegate
Scanlan to move suspension of rules to
permit immediate consideration, but will
not do so until after the resolution is
printed and on your desk.

The Parliamentarian reminds the Chair
that under the rules the resolution should
be referred to the Committee on Rules,
Credentials and Convention Budget, and
the resolution will be referred to that
Committee, but the Chair will recognize
Delegate Scanlan as soon as the printed
copy is available to move suspension of
rules to permit immediate consideration.

I think we should probably go into a
Committee of the Whole to conclude con-
sideration of GP-13.

The Chair recognizes Delegate Borom,
Vice-President of the Committee on Cal-
endar and Agenda.

DELEGATE BOROM: Mr. President, I
move that the Convention resolve itself
into a Committee of the Whole for the pur-
pose of considering the general orders of
the day.

THE PRESIDENT: Is there a second?
(T/K' motion was did n seconded.)

THE PRESIDENT: All those in favor,
signify by saying Aye; contrary, No.

The Ayes have it. It is so ordered.

(Whereupon, at 2:50 P.M., the Conven-
tion resolved itself into t fie Com mit Ice of
the Whole.)

(The mace was removed by the Scracant-
al-Arms.)
