Do you have an amendment to section
33?

DELEGATE MOSER: It is a new sec-
tion to be added. There are two of the
same number. This would be Amendment F.

THE CHAIRMAN: There are actually
three amendments to add new sections. I
take it you are saying your Amendment F
will supplant Amendment D?

DELEGATE MOSER: That is correct.
Amendment D as in "dog".

THE CHAIRMAN: Pages will distribute
Amendment F for "fox".

Delegate Rybczynski, did you desire the
floor?

DELEGATE RYBCZYNSKI: Just to
ask you, sir, to hold open the possibility of
a new Section 19- A for tomorrow. If we
are going to close any business tonight —

THE CHAIRMAN: This is an entirely
new section?

DELEGATE RYBCZYNSKI: Yes, Mr.
Benson and I decided to handle it that way.
It has to do with the Orphans' Court.

THE CHAIRMAN: It is marked 20-A,
the one I have. Is that it?

DELEGATE RYBCZYNSKI: Either one,
yes, sir.

THE CHAIRMAN: That could be added
to the schedule even after second reading
on this part. Would you see the Chair about
that immediately at the conclusion of the
session tonight, Delegate Rybczynski, for
just a moment.

DELEGATE RYBCZYNSKI: Yes.

THE CHAIRMAN: This will be Amend-
ment No. 11.

The Clerk will read the amendment.

READING CLERK: Amendment No. 11
to Committee Recommendation GP-13 by
Delegates Moser and Hardwicke: On page
29 following line 33 of section 33, County
Surveyors, add this new section :

"Section 33A. County Elections.

All elections for county offices held in
November, 1970, shall be for those offices
provided for by the instrument of govern-
ment effective or to become effective on
January 6, 1971, for that county."

THE CHAIRMAN: The amendment is
offered by Delegate Moser and seconded by
Delegate Hardwicke.

The Chair recognizes Delegate Moser.

DELEGATE MOSER: Mr. Chairman,
this provision originally was a last sen-
tence in one of the items of the transitional
provisions relating to local government. It
was, however, pointed ou that the legisla-
ture is empowered under the Suffrage and
Elections Provision of the Constitution to
change the dates of county elections, and,
accordingly, at our suggestion, this sen-
tence was to have been moved into the
schedule of legislation and out of the tran-
sitional provisions to enable the legislature
if they wanted to, to amend the provision.

Through inadvertence it was not typed
with the schedule of legislation.

What this does is self-evident, I think.
It simply provides that the county elections
held in November of 1970 shall be for those
offices which are provided for in the county
instrument of government, which will be-
come effective on January 6, 1971, or in
the county instrument of government that
is already in effect.

I think no further explanation is
necessary.

THE CHAIRMAN: Is there any further
discussion?

(There was no response.)

The question arises on the adoption of
Amendment No. 11 to Committee Recom-
mendation GP-13.

A vote Aye is a vote in favor of Amend-
ment No. 11. A vote No is a vote against.

(Whereupon, a roll call vote was taken.)

Has every delegate voted? Does any dele-
gate desire to change his vote?

(There was no response.)
The Clerk will record the vote.

There being 88 votes in the affirmative,
and none in the negative, the motion car-
ries. The amendment is adopted.

Delegate Grant, do you desire to offer
your Amendment P?

DELEGATE GRANT: Yes, I do, Mr.
President.

THE CHAIRMAN: The pages will please
