3022 CONSTITUTIONAL CONVENTION OF MARYLAND [Jan. 2]

DELEGATE JAMES (presiding) : Just a
moment.

Let us proceed. I think we can proceed
with your amendment.

READING CLERK: Amendment No. 1,
on Style, as amended by Report No. S&D-
17 to Committee Recommendations Nos.
GP-7, GP-8, GP-9, GP-12, R&P-1, and LB-3,
by Delegate Needle. On page 2, section
10.03, constitutional convention, strike out
beginning with the word "within" in line
32 and extending through the word "ap-
point" in line 35 and insert in lieu thereof
the following: "Within sixty days after
such approval by the voters or within sixty
days after the General Assembly calls a
convention, the governor shall appoint".

DELEGATE JAMES (presiding): Does
everyone have a copy of Amendment E ?

The pages will please see that everyone
has a copy of Amendment E.

Does this not merely restore the original
language ?

DELEGATE NEEDLE: That is right.

DELEGATE JAMES (presiding): I am
advised that the proper way to handle this
is by simply taking a vote on the amend-
ment offered by the Committee on Style.
If this is rejected, the original language
is automatically restored.

DELEGATE NEEDLE: That would have
been acceptable, Mr. Chairman, and you
may be able to do it in that fashion; only
this relates to one of the amendments rec-
ommended by the Style Committee to this
entire section. I do not know if you can
divide all of the amendments to this section
as proposed by the Style Committee.

DELEGATE JAMES (presiding): It is
perfectly possible to have a division of the
question on every amendment offered by
the Committee on Style. If you ask for a
division of the question on this particular
amendment, it will be perfectly proper.

DELEGATE NEEDLE: That would be
fine. I just did not want to make it too
cumbersome.

DELEGATE JAMES (presiding): Are
both of your amendments restorations of
the original language?

DELEGATE NEEDLE: Exactly.

DELEGATE JAMES (presiding): All
right.

When we reach it, the way we will pre-
sent the question, will be simply to aban-

don the amendments. If Delegate Needle
is asking for division of the question in
considering the amendments offered by the
Committee on Style as to section 10.03, the
Chair will read the amendments and sub-
mit them separately.

DELEGATE NEEDLE: Is this the ap-
propriate time to do that, Mr. Chairman,
or should I wait until we are ready for the
vote on each section?

DELEGATE JAMES (presiding): I be-
lieve it is proper to do it now.

The Chair so rules.

I do not have anything to base it on, but
the Chair rules we will do it now.

DELEGATE NEEDLE: In that case, I
move that the Committee of the Whole not
concur in the style amendment recom-
mended on lines 32 through 35 on page 2 of
S&D-17.

DELEGATE JAMES (presiding): I
think the proper way to handle it is for
the Chair to submit each one of these
amendments separately and take a sepa-
rate vote.

The first amendment to be submitted is
the amendment of the Committee on Style
in section 10.03, the language on lines 20,
21 and 22. The question arises as to the
adoption by the Committee of the amend-
ment on style as a separate amendment.

Delegate Chabot.

DELEGATE CHABOT: If we proceed in
this manner, I am afraid we run the risk
of overlooking one or two odds and ends of
amendments as we have just passed the
amendment in line 18.

DELEGATE JAMES (presiding): The
simplest thing to do would be to take a
vote on his amendments, and the Chair is
going to go back to that procedure. I think
that is the simplest thing to do.

If the Clerk will read Amendment E, I
think that is the simplest way to handle it.

The Clerk will read Amendment E, and
we will consider Amendment E as an
amendment on style.
