3010 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 30]

THE PRESIDENT: I do not think you
even need the "at reasonable times", if you
are going to provide it for both.

DELEGATE GALLAGHER: Then I
would drop "at reasonable times". It was
originally dropped, but the Style Commit-
tee indicated that it intended "at rea-
sonable times" should follow the word
"public", so it can be dropped, and I would
do so.

THE PRESIDENT: I am sorry. I did
not know that it had been returned. It was
not on my copy.

Would you state it again, Delegate Gal-
lagher ?

DELEGATE GALLAGHER: I believe
it should read as follows: "Each House
shall provide by rule that the daily journal
shall be published as soon as practicable,
and that a transcript of debates may be
made available to the public at reasonable
times."

THE PRESIDENT: In line 18 I under-
stand the word "provide" has already been
changed to "prescribe", Delegate Gallagher.

DELEGATE GALLAGHER: That is cor-
rect, everywhere the word "provide" is
used, it now reads "prescribe".

THE PRESIDENT: Is there any objec-
tion to considering an amendment to
change the word "the" in line 20 to "a",
and to insert after the word "shall" in line
21 the words "be made" ?

The Chair hears none. This will be
Amendment No. 12.

Delegate Rybczynski.

DELEGATE RYBCZYNSKI: I do object
and, if I may, I would like to state my
reasons.

THE PRESIDENT: Do you object to it
because it is not printed?

DELEGATE RYBCZYNSKI: Well, for
whatever reason is available. That is as
good a reason as any, yes, sir.

THE PRESIDENT: Delegate Ryb-
czynski.

DELEGATE RYBCZYNSKI: I do not
want to be the dirty guy here, but I stood
up to merely complete what had previously
been done by the chamber. I deferred to
Delegate Gallagher to do the same thing.

Now, we are about to put back in what
we just took out.

THE PRESIDENT: Very well, your
point is well taken. The Chair will recog-
nize you to make your motion.

DELEGATE RYBCZYNSKI: Mr. Presi-
dent, I move that on line 20, 21 and 22 of
page 7, section 3.19, that we delete the
words "and that the transcript of debates
shall be available to the public."

THE PRESIDENT: The words "at rea-
sonable times" are inserted after "public".
I assume you would take those out also,
Delegate Rybczynski.

DELEGATE RYBCZYNSKI: Yes, sir.

THE PRESIDENT: Is there any objec-
tion to considering, although not printed,
the amendment to delete from lines 20, 21
and 22 the words "and that the transcript
of debate shall be available to the public
at reasonable times"?

Delegate Stern.

DELEGATE STERN: Mr. President, Mr.
Storm, who could not be here at this time
today, asked me to introduce his motion
which is lettered "K",—

THE PRESIDENT: Are you objecting to
the consideration of the pending motion,
because it is not printed ?

DELEGATE STERN: I would not object
to that, but I wonder if we could postpone
it. If Delegate Storm's motion were put in
we would have to change Delegate Storm's
motion as it is printed.

First we would have to change it because
of the last vote, and then have to change
it to include the language that would be
struck if this were voted upon and ap-
proved.

THE PRESIDENT: I hesitate very much
to do it, but it seems to me that as a prac-
tical matter the only reasonable way to
handle it then would be for somebody, if
they so desire, to ask for a division with
respect to section 3.19, and to make it the
special order for Tuesday, also.

Delegate Stern.

DELEGATE STERN: I am not asking
for that. I am just asking if we can post-
pone it until we put Delegate Storm's
amendment in, if you will allow me to
make the motion now which he requested
me to do.

THE PRESIDENT: As a substitute, is
that what you mean ?

DELEGATE STERN: Yes, sir.
