2998 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 30]

I incorrectly stated the motion.

The question arises on the adoption of
the recommendations of the Committee on
Style with respect to amendments to Com-
mittee Recommendation LB-1, LB-2 and
LB-3, except with respect to sections 3.03,
3.04 and 3.23.

A vote 'Aye is a vote in favor of the
adoption of the Committee Recommenda-
tions to the extent indicated. A vote No is a
vote against.

(Whereupon, a roll call vote was taken.)

THE PRESIDENT: Have all delegates
voted?

Does any delegate desire to change his
vote?

(There was no response.)
The Clerk will record the vote.

There being 108 votes in the affirmative
and none in the negative, the motion is car-
ried. The Committee Recommendations as
to amendments to Committee Recommenda-
tions LB-1, LB-2 and LB-3, other than sec-
tions 3.03, 3.04 and 3.23, are adopted.

Committee Recommendation LB-1 is now
open to amendment. Are there any amend-
ments as to section 3.01? The Chair hears
none.

Are there any amendments as to section
3.02? The Chair hears none.

Are there any amendments as to section
3.05?

DELEGATE WINSLOW: May I ask a
question about section 3.02?

THE PRESIDENT: Certainly.

DELEGATE WINSLOW: As 3.02 reads,
the capital of the state and the meeting
place of the General Assembly shall be at
Annapolis. This seems to me to be a bold
statement which would allow the meeting
place of the General Assembly to be shifted
no place else for any occasion, and since
we have become aware, some of us, that
Annapolis is a very good place for someone
to get the foot-in-mouth disease, it might
be wise, it seems to me, to have some es-
cape hatch from this bold statement.

I want to ask whether the provision in
the last section in S&D-17, which is con-
cerned with the continuity of government
during emergencies, -would take care of
this situation?

THE PRESIDENT: What section are
you speaking to, Delegate Winslow?

DELEGATE WINSLOW: The last one
marked Article 1, Declaration of Rights,
section blank, Continuity of Government.

THE PRESIDENT: I have it.

Delegate Gallagher, do you understand
the question?

DELEGATE GALLAGHER: I do, Mr.
President.

It was the intention of the Committee on
the Legislative Branch that the language
which is now in S&D-17, which was origi-
nally in LB-3, would cover that kind of a
situation. You could transfer the meeting
place of the General Assembly to another
place under the appropriate provisions of
the law as suggested.

TPIE PRESIDENT: Is there any fur-
ther question, Delegate Winslow?

Delegate Raley.

DELEGATE RALEY: Mr. President, in
following along what Delegate Winslow
said about the state capital, I have been
having a good deal of problem with that,
too. Some of my constituents down in St.
Mary's City have been very disturbed over
this being in the Constitution, and were
wondering why we could not have taken it
out so that the capital could have been re-
turned to its original place.

THE PRESIDENT: Delegate Gallagher.

DELEGATE GALLAGHER: May I sug-
gest a single member capital for St. Mary's
County.

THE PRESIDENT: Any amendment to
section 3.05? We have Amendment S.

Delegate Gallagher.

DELEGATE GALLAGHER: Yes, Mr.
President, I would like to offer amendment
S, please.

THE PRESIDENT: Which of the two
obvious words do you choose?

— sweet and sour. This will be Amendment
No. 7. The Clerk will read the amendment.
