THE PRESIDENT: Pages please dis-
tribute amendment N.

This will be Amendment No. 17.
The clerk will read the amendment.

READING CLERK: Amendment No. 17
to Committee Recommendations EB-1 and
EB-2 as amended by Report S&D-13, by
Delegate Morgan: On page 13, section 4.31,
Interim and Recess Appointments, in line 3
strike out the word "recess" and insert in
lieu thereof the word "adjournment".

THE PRESIDENT: Amendment No. 17
is submitted by Delegate Morgan. Is there
a second ?

(Whereupon, the amendment was duly
seconded.)

THE PRESIDENT: The amendment has
been seconded by Delegate Bennett.

The Chair recognizes Delegate Morgan.

DELEGATE MORGAN: This is simply a
clarifying amendment. We think, and I be-
lieve the Chairman of the Style and Draft-
ing Committee thinks, that adjournment of
the Senate more accurately describes what
we have in mind when we are talking about
these interim appointments, instead of re-
cess of the Senate.

The Senate can recess from time to time,
but during the adjournment, why that
really means during the sine die adjourn-
ment.

THE PRESIDENT: Are there any ques-
tions of the Committee Chairman? Is there
any discussion?

Are you ready for the question?

The question arises on the adoption of
Amendment No. 17 to Committee Recom-
mendation EB-1 and EB-2 as amended by
S&D-13. A vote Aye is a vote in favor of
Amendment No. 17. A vote No is a vote
against.

Cast your votes.

Has every delegate voted? Does any
delegate desire to change his vote?

(There was no response.)

DELEGATE KIEFER: Mr. President, we
missed the last couple of these amend-
ments. Have they been printed ?

THE PRESIDENT: The amendments
have been printed and distributed.

DELEGATE KIEFER: They do not get
over this far.

THE PRESIDENT: I am sorry.

Any delegates who do not have Amend-
ment W for William, please hold up your
hand and the pages will come to you with
Amendment W.

Delegate Della.

DELEGATE DELLA: On this last
amendment introduced by Delegate Mor-
gan, where you insert adjournment instead
of recess, do you know that the Senate ad-
journs every day?

T,HE PRESIDENT: Delegate Morgan.

DELEGATE MORGAN: Well, this is
supposed to mean a sine die adjournment.

THE PRESIDENT: Delegate Della.

DELEGATE DELLA: I am not clear
about this, but in the context in which the
sentence is used in this particular section,
the last part, would it make any difference
whether we were thinking of adjournment
overnight or adjournment sine die?

I do not think it matters at all, except
that the word "adjournment" was used, and
the Senate also adjourns everyday. I do not
know whether they were taking that into
consideration or not.

THE PRESIDENT: Delegate Morgan, as
I understand the sentence, it would not
make any difference whether the adjourn-
ment was adjournment sine die or adjourn-
ment overnight, is that correct?

DELEGATE MORGAN: You are correct,
Mr. President, it would not.

THE PRESIDENT: I take it literally
that it would not make any difference if it
were a recess, either, so long as "recess"
included "adjournment". Is that correct?

DELEGATE MORGAN: Yes.
THE PRESIDENT: Very well.

The vote on Amendment No. 17 has been
recorded. The Chair has not announced it.

Does any delegate desire to change his
vote on that amendment?

On Amendment No. 17, there being 102
votes in the affirmative and 2 in the nega-
tive, the amendment is adopted.

Has any delegate not received a copy of
Amendment C?

Has any delegate not received a copy of
