Delegate Morgan, do you desire to offer
your Amendment W?

DELEGATE MORGAN: Mr. President,
last night Delegate Grant asked me some
questions about this section, and I would
like to expand a little bit on my answer.

THE PRESIDENT: First, do you desire
to offer the amendment?

DELEGATE MORGAN: I do.

THE PRESIDENT: Let us get it dis-
tributed, first. I am not sure it is printed
yet.

The pages will please distribute Amend-
ment W, "W" for William.

T.his will be Amendment No. 16.
The Clerk will read the amendment.

READING CLERK: Amendment No. 16
to Committee Recommendation No. EB-1
and EB-2 as amended by Report S&D-13
by Delegate Morgan:

On page 12, section 4.30, Appointment
and Removal of Other Persons, in line 18
after the word "or" add the words "whose
method of"; and in line 20 strike out the
word "and" and insert in lieu thereof the
word "or".

THE PRESIDENT: The amendment is
submitted by Delegate Morgan. Is there a
second?

(Whereupon, the amendment was duly
seconded.)

THE PRESIDENT: Delegate Grant sec-
onds the amendment.

The Chair recognizes Delegate Morgan.

DELEGATE MORGAN: Delegate Grant
asked me last night whether this appoint-
ment or removal was in the disjunctive. I
told him it was. The Executive Branch
Committee as a committee never did con-
sider this question as such. There was never
any question in my mind but what the ap-
pointment or removal was in the disjunc-
tive, and this section applied to the removal
of officers as well as to the appointment of
officers, and again gave the General Assem-
bly the power to deal with that problem.

In reading the section, however, it
seemed to me that there was some question
about that "and" if the word "and" was
used in line 20, and so one of the things this
amendment does is to strike out the word
"and" and put in place of it "or". And to
make sure it means what I said it meant
last night, to insert "for removal whose
method is not specifically provided," and so
forth.

THE PRESIDENT: Are there any ques-
tions of the Committee Chairman?

(There was no response.)

The question arises on the adoption of
Amendment No. 16 to Committee Recom-
mendation EB-1 and EB-2 as amended by
S&D-13. A vote Aye is a vote in favor of
Amendment No. 16. A vote No is a vote
against.

There being 93 votes in the affirmative
and 3 in the negative, the motion is carried
and the amendment is adopted.
