You use the phrase, in line 5, "all public
records." I am unclear as to what is meant
by that. I assume it would include, for in-
stance, court records of all kinds. Would it
include all records filed with public agen-
cies which are not normally thought of as
public, such as income tax returns?

DELEGATE STORM: In case it would
cover that, I would think the legislature
would immediately eliminate that.

THE CHAIRMAN: I dare say but what
I am trying to find out is what you intend
by the term "all public records".

DELEGATE STORM: I meant all public
records, including those filed with any
agencies.

THE CHAIRMAN: In other words, all
records, even of a private character, if they
are filed with a public agency?

DELEGATE STORM: Yes, sir.

THE CHAIRMAN : Income taxes may be
a bad example. For instance, statements of
any kind filed with any of the regulatory
agencies, Public Service Commission, In-
surance Department, any of those?

DELEGATE STORM: Yes, sir.

THE CHAIRMAN: Very well. The
Chairman of the Committee on Style could
note that.

Is there any discussion?

DELEGATE BAMBERGER: Will Dele-
gate Storm yield for a question?

THE CHAIRMAN: Delegate Storm, do
you yield for a question?

DELEGATE STORM: Yes.
THE CHAIRMAN: Delegate Bamberger.

DELEGATE BAMBERGER: Public rec-
ords include records of municipalities, coun-
ties, other governmental units and if it
does, does this amendment provide that only
the General Assembly could act with respect
to those records ?

THE CHAIRMAN: Delegate Storm.
DELEGATE STORM: Yes.
THE CHAIRMAN: Delegate Grant.

DELEGATE GRANT: I have a question
of Delegate Storm.

Do you intend the words in line 7 "to the
extent and in the manner provided by law"
as a modifier to the public records, or as a

modifier on governmental proceedings and
meetings?

THE CHAIRMAN: Delegate Storm.

DELEGATE STORM: Only to the govern-
mental proceedings and meetings.

THE CHAIRMAN: Is there any further
discussion ?

(There was no response.)

The question arises on the adoption of
Amendment No. 26 to Committee Recom-
mendation R&P-2.

A vote Aye is a vote in favor of Amend-
ment No. 26. A vote No is a vote against.

There being 54 votes in the affirmative
and 65 in the negative, the motion is lost.
T,he amendment is rejected.

That concludes consideration of Commit-
tee Recommendation R&P-2. The Chair
would suggest to the Chairman of the Com-
mittee on Calendar and Agenda the proce-
dure outlined by the Chair earlier in moving
that the Committee of the Whole rise. The
Chair recognizes Delegate Powers.

DELEGATE POWERS: Mr. Chairman, I
move the Committee of the Whole rise and
report its approval of Committee Recom-
mendation R&P-2, with the exception of
Sections 10, 11, 13.

THE CHAIRMAN: Approval with amend-
ments ?

DELEGATE POWERS As amended.
THE CHAIRMAN: Is there a second?
Delegate Bamberger.

DELEGATE BAMBERGER: A point of
parliamentary inquiry.

THE CHAIRMAN: State the inquiry.

DELEGATE BAMBERGER: Mr. Chair-
man, have we voted to approve R&P-2 as
