by striking the word "providing" and in-
sert therein the word "fostering"? The
Chair hearing no objection, the amendment
will be so modified.

The delegates have before them Amend-
ments No. 14 and 23, proposed by Delegate
Morgan and seconded by the other dele-
gates, in the opinion of the Chair sub-
stantially identical with Amendment No.
14. Amendment No. 14 was adopted by a
vote of 97 to 13, and then the entire section
as thus amended deleted by the adoption
of Amendment No. 15 by the vote of 73 to
40.

The Chair feels that Amendment No. 23
is out of order because it is substantially
identical with Amendment No. 14. The
question, however, is not free from doubt.
The Chair does not wish to be arbitrary
and will therefore submit the question of
whether the amendment is in order to a
vote of the Committee of the Whole with-
out debate.

The question therefore now arises wheth-
er Amendment No. 23 be received. A vote
Aye will be a vote in favor of considera-
tion of Amendment No. 23. A vote No will
be a vote against consideration of Amend-
ment No. 23, that is, that it is out of
order.

This is not a vote on either adoption or
rejection of the amendment, but merely
whether further debate shall be permitted.
So that you may thoroughly understand
the question, I will ask the Clerk first to
read Amendment No. 14, and then Amend-
ment No. 23, but before doing that I will
ask the Clerk to ring the quorum bell.

The Clerk will read Amendment No. 14
and then Amendment No. 23.

READING CLERK: Amendment No. 14
to Committee Recommendation R&P-2, by
Delegate Kiefer:

On page 3 strike out all of section 9,
Economic Opportunity, comprising lines 22
through 30, inclusive, and insert in lieu
thereof the following:

"Section 9. General Welfare of the peo-
ple.

It is the policy of the State that all per-
sons shall have economic security and the
opportunity for employment, in order that
they may live in decency, dignity, and
health. The General Assembly shall con-
tinue to implement this policy."

THE CHAIRMAN: Now Amendment
No. 23.

READING CLERK: Amendment No. 23
to Committee Recommendation R&P-2,
Delegates Morgan, E. J. Clarke, Bam-
berger, Kiefer, Mitchell, Gallagher, Hop-
kins, Bennet and L. Taylor.

On page 3 immediately preceding line 32
of section 10, Criminal Jury, Judge of
Law and Fact, add the following new sec-
tion:

"Section ——— General Welfare of the
People.

It is the policy of the State to promote
the general welfare by fostering, among
other things, wherever practicable, oppor-
tunity for employment for all persons in
order that they shall have economic security
and may live in decency, dignity, and
health."

THE CHAIRMAN: The question before
you is whether Amendment No. 23 is in
order, that is, whether it be received.

A vote Aye is a vote that the amend-
ment is in order, and may be received for
debate. A vote No is a vote that the amend-
ment is not in order.

Cast your votes. Has every delegate
voted? Does any delegate desire to change
his vote?

Delegate James Clark, will you announce
your vote orally?

DELEGATE J. CLARK: No.

THE CHAIRMAN: Delegate James
Clark votes no.

The Clerk will record the vote.

There being 46 votes in the affirmative
and 62 votes in the negative the motion is
lost. The amendment is out of order.

I am in error. Forty-six votes in the
affirmative, and 61 votes in the negative,
and the amendment is out of order.

The only other amendment to the Com-
mittee Recommendation is in connection
with Minority Report R&P-1(C). You will
recall that this minority report was
tendered in connection with the Committee
Recommendation R&P-1. At the request of
the Chair, Delegate Willoner agreed to
hold it until consideration of this amend-
ment so that we could conclude considera-
tion of Committee Recommendation R&P-1.

The Chair recognizes Delegate Willoner
to present the Minority Report and sug-
gests that he come forward.
