2364 CONSTITUTIONAL CONVENTION OF MARYLAND [Dec. 13]

DELEGATE MACDONALD: Does the
phrase here, Mr. Delegate Penniman, mean
public general law?

DELEGATE PENNIMAN: The phrase
here has the same meaning as public gen-
eral law. That is correct.

THE PRESIDENT: Is there any further
discussion ?

(There was no response.)
Are you ready for the question ?
(Call for the question.)

The question arises on the approval of
the amendments proposed by the Committee
on Style, Drafting and Arrangement with
respect to Committee Recommendation GP-

4.

A vote Aye is a vote in favor of the
amendments. A vote No is a vote against.

Cast your votes.

Has every delegate voted? Does any dele-
gate desire to change his vote ?

(There was no response.)
The Clerk will record the vote.

There being 114 votes in the affirmative
and 3 in the negative, the motion carries.
The amendments proposed by the Commit-
tee on Style, Drafting and Arrangement are
adopted.

The question now arises on the approval
of Committee Recommendation GP-4 as
amended. The Chair has received one amend-
ment.

Delegate Freedlander, do you desire to
submit your amendment?

DELEGATE FREEDLANDER: Yes, Mr.
President.

THE PRESIDENT: The pages will please
distribute the amendment, Amendment A.

This will be Amendment No. 1. The Clerk
will read the amendment.

READING CLERK: Amendment No. 1
to Committee Recommendation GP-4, as
amended by Report S&D-5, by Delegate
Freedlander:

On page 1 of the report strike out all of
section , Consumer Protection, com-
prising lines 3 through 8, inclusive.

THE PRESIDENT: The amendment is
proposed by Delegate Freedlander.

Is there a second?

Delegate Freedlander, as the Chair under-
stands the amendment, it is to strike the
entire recommendation. I do not think that
is in order. You can accomplish the same
purpose in one of two ways: either by mo-
tion for indefinite postponement, or what
would be simpler and accomplish the same
purpose, a vote opposing approval or adop-
tion of the Committee Recommendation.

The amendment is not necessary to ac-
complish your purpose, if the Chair under-
stands your purpose.

DELEGATE FREEDLANDER: Thank
you very much.

I will choose the second method you
mentioned.

T;HE PRESIDENT: very well.

Amendment No. 1 is scratched. It has
not yet been offered.

Delegate Hostetter.

DELEGATE HOSTETTER: Mr. Presi-
dent, a point of parliamentary inquiry. Since
the amendment is scratched, that eliminates
all discussion and debate. Is that correct?

THE PRESIDENT: It does not. The ques-
tion now arises on the adoption of the Com-
mittee Recommendation as amended. That
is debatable. The Chair would intend to
recognize Delegate Freedlander. It is sub-
ject to full debate, in accordance with the
policy heretofore announced.

DELEGATE HOSTET.TER: Thank you,
sir.

THE PRESIDENT: The question now
arises on the adoption of Committee Rec-
ommendation GP-4 as amended.

The Chair recognizes Delegate Freed-
lander.

DELEGATE FREEDLANDER: Mr. Pres-
ident and fellow delegates:

It is not my intention to delay the dis-
cussions of this evening nor to prolong the
discussions; nor am I against consumer pro-
tection.

I am very much in favor of consumer
protection. It is precisely for that reason
that I rise, because I am in favor of the
General Assembly providing by law for the
protection and education of the citizens of
the State against harmful and unfair busi-
ness practices.

Shortly after the conclusion of our de-
bates on this topic I received in the mail
the attorney general's digest, which I have
