DELEGATE MENTZER: We have done
these things in the past with this prohibi-
tion in our Constitution through this lib-
eral construction of gift of assets. I just
do not understand Judge Sherbow's argu-
ment.

THE CHAIRMAN: Is there any fur-
ther discussion?

Delegate Gallagher.

DELEGATE GALLAGHER: Delegate
Mentzer, in reading Article III, Section 3.4
of the present Constitution, the precise
sentence is "The credit of the State shall
not in any manner be given or loaned to
or in aid of any individual, association or
corporation."

The language of your Amendment No. 4,
you have added the words "for any pur-
pose", so that the credit of the State shall
not in any manner or for any purpose be
given or loaned. What is the significance
of the inclusion of the phrase "or for any
purpose"?

THE CHAIRMAN: Delegate Mentzer.

DELEGATE MENTZER: The idea was
to avoid the words "public purpose" be-
cause I felt they were vague and would
just have to be determined by court de-
cisions over and over again.

THE CHAIRMAN: Is there any fur-
ther discussion?

(There was no response.)

The question arises on adoption of
Amendment No. 4. A vote Aye is a vote in
favor of the amendment. A vote No is a
vote against.

There being 9 votes in the affirmative
and 82 in the negative, the motion is lost.
The amendment is rejected.

Are there any other amendments to sec-
tion 6.02?

If not, the question arises on the ap-
proval of Committee Recommendation SF-4.

and 12 in the negative the Committee Rec-
ommendation SF-4 is approved.

I move the Committee of the Whole rise
and report its approval of Committee Rec-
ommendation SF-3 and Committee Recom-
mendation SF-4.

THE CHAIRMAN: Is there a second?

(Whereupon, the motion was duly sec-
onded.)

THE CHAIRMAN: All those in favor,
signify by saying Aye. Contrary, No. The
Ayes have it. It is so ordered.

(Whereupon, at 6:40 P.M., the Committee
of the Whole rose, and the Convention re-
convened.)

THE PRESIDENT: The Convention will
please come to order.

On behalf of the Committee of the Whole,
the Chair reports that the Committee of
the Whole has had under consideration
Committee Recommendation SF-3 and that
it has approved Committee Recommenda-
tion SF-3. That the Committee of the
Whole has also had under consideration
Committee Recommendation SF-4 and that
it has approved Committee Recommenda-
tion SF-4.
